Proportionate Share (34 CFR § 300. 130 -148) Portion of IDEA Part B funds that must be reserved and spent to provide equitable services to parentally placed private, parochial, and home schooled children with disabilities, ages 5 -21, who have been evaluated and determined eligible for special education and related services by the LEA. Spending Proportionate Share Funds Parentally placed private and home school students should begin receiving services at the same time as pubic school enrolled students with disabilities. Proportionate Share funds can be used in the following ways: Distributed for services identified in students’ service plan who attend private/parochial/home schools Have LEA employed staff or contractors provide services or training at the public school or at a neutral site for private school staff who work with students with disabilities Provide transportation for students to receive Proportionate Share services Proportionate Share funds cannot be used in the following ways: Pay for child find costs Paid directly to the private, parochial, or home school Utilizing services, equipment, and personnel onsite at a student’s private school
May the LEA Spend More? q PART B FUNDS: Yes, as long as the LEA meets all the other requirements of IDEA, including providing a Free Appropriate Public Education (FAPE) to public school children with disabilities. q STATE/LOCAL: Yes, but only to supplement, and not supplant, the proportionate share of federal funds required. This means the LEA must spend ALL federal proportionate share funds prior to utilizing state and local funds. Additional state and local must be counted in MOE.

Graduation Codes G 01: Graduated by earning all required credits through regular or modified classes aligned with state [regular grade level] standards. No credits were earned by meeting IEP goals. G 03: Graduated by earning some or all required credits through modified classes aligned with alternate standards or by meeting IEP goals. This would generally be limited to those students with the most significant cognitive disabilities whose IEP teams have determined that this method of graduation provides FAPE to the individual student.
