Definition – AC 11 “Scientists, engineers or technicians admitted by the Organization to contribute their expertise on behalf of their home institution to the execution of project-related activities designated by the Director -General, under an agreement between the Organization and their home institution. They shall be employed by their home institution. The maximum duration of the contract of association as a project associate shall be three years. ” 3/1/2021 HR Department 10
General principles– AC 11 • • Appointment by DG on basis of a contract of association (in this case, to promote international collaboration). Legal link to a home institution (scientific institute which is the employer) for the duration of the contract of association. Need for adequate financial resources from an outside source. supplemented by the Organization to cover additional costs in local area. Must have social insurance cover through home institution or on own responsibility. 3/1/2021 HR Department 11
Eligibility • Employer must be a scientific institute (no commercial firms) must ensure employment throughout the duration of association Countersigns compliance with conditions regarding • • • financial resources social insurance covering economic consequences of risks related to illness and accidents (CH & FR; PJAS & family) Collaboration agreement explicitly authorises appointment of 1 or more PJAS for a given project. 3/1/2021 HR Department 12
Conditions • Subsistence allowance: • • Fixed amount, increase i. f. o. family accompanying Break in payment in case of subsequent statuses (min. half of period during which subsistence received) • Duration of association (<1 yr - 3 yr max. *) • Authorised absences (standard), as well as maternity & sick leave. * Exception made in 2002 – up to 5 yrs (until 2009) 3/1/2021 HR Department 13
Setting up agreements • • Call for collaboration Framework Collaboration Agreement between CERN & scientific institution (negotiation of terms, FC approves) • addenda define the elements of specific collaboration efforts incl. contribution for the project. • often longer-term investment with contracts typically growing over time. 3/1/2021 HR Department 14
Setting up agreements • • • Work can be carried out at Institute or at CERN. Financial Model based on assessment of cost when outsourced to industry. Negotiation of terms by technical department: • Lump-sum per capita per month to institute to cover admin. costs and subsistence payment to the individual PJAS by CERN to complement salary (typical for larger teams). • % Split of estimated personnel cost & subsistence by CERN to complement salary. 3/1/2021 HR Department 15
CERN role & responsibilities Ensures contractual conditions are met: • • Employment by home institute: • • • Appropriate social cover (health insurance!) • • • For duration contract of association Respecting % work of employment contract (min. 55%). Individual PJAS may seek (additional) coverage ! Retirees, duty travel… Max. duration of contract association and breaks in subsistence payment. Provides subsistence allowance (basis SRR). Provides appropriate work environment and conditions (facilities, services), safety on site (& duty travel), training (on the job, possibly other). 3/1/2021 HR Department 16
Collaborating institute’s role & responsibilities • Remains & acts as employer: • Employment contract • Ensure appropriate social cover incl. coverage professional risks (liability) • Ensure all health obligations & signs related authorisations • Decides on the individuals to become detached as PJAS (CERN at most consultative input). 3/1/2021 HR Department 17
