The Purpose of This Policy The purpose of this policy is to describe management's administrative responsibilities and procedures after a team member's work-related injury or illness. This policy also describes how administrative procedures for first-aid treatment are different from other work-related injuries and illnesses. Before You Begin Administrative Actions In the event of a team member’s injury or illness first follow the emergency procedures described in the section Employee Injury or Illness in the Emergency Response Guide. After the emergency, follow the procedures in the policy Employee Accident Investigation. Then follow the administrative procedures described in this policy. Safety Administration Guide, 083 Employee Accident and Illness Administrative Requirements C. First Aid or Workers' Compensation? It is important to determine whether the medical treatment provided for an injured or ill employee is or is not considered first-aid. The administrative procedures are different for first-aid cases, because they are not treated as workers’ compensation claims. Generally, it is a first-aid case if the worker is treated and returns to work the same day (or if he or she could have returned to work), even if the injury or illness was work related. If the employee returned to work the same day with a modified work capability, however, it is not a first-aid case. For example, if a worker twists an ankle and is returned to work the same day with the instructions to only work sitting down, it is not a first-aid case. An injury or illness is not a first-aid case if the employee was required to miss additional days of work. First-aid Administrative Procedure When you have determined that the medical treatment provided to an employee is first-aid treatment, instruct the medical-treatment provider to send the invoice directly to the Hotel. If possible, pick up the invoice while you are at the clinic or hospital and take it to the general manager. If it is not a first-aid case, follow the procedure in the next section. Administrative Procedures for the Manager-on-duty The manager-on-duty takes the following administrative procedures after providing emergency treatment and completing the accident investigation for a job-related employee injury or illness (except first-aid cases): 1. Be certain that the completed form Order for Medical, Surgical or Hospital Aid was presented to the medical organization providing treatment. If it was not, complete the form and immediately deliver it. 2. Get a workers’ compensation insurance claim form from the incident response bag. Give the form to the injured or ill employee. Instruct him or her to complete and sign the form as completely and accurately as possible. 4. After the injured team member has completed and signed the workers’ compensation insurance claim form, complete the remaining sections. 5. Deliver the completed Workers’ Compensation Insurance Claim Form to Reported Industrial Injury or Illness to the Hotel general manager. Do not separate or distribute the forms. 7. In California, deliver to the injured or ill employee the pamphlet Facts for Injured Workers or the Spanish version, Hechos para Trabajoadores Lastimados. The General Manager's Administrative Procedures After a job-related Employee Injury or Illness, the general manager and/or office manager take the following actions: 1. Check that all forms and reports have been completed and signed. Discuss and resolve any discrepancies with the supervisors and employees involved. 3. Complete and sign the workers’ compensation insurance claim form. 4. Separate the copies of the forms Employee's Claim for Workers' Compensation Benefits, Employer's Response to Reported Industrial Injury or Illness and Employers Report of Occupation Injury or Illness as instructed on each form. 5. If approved by the Company, distribute the forms as instructed on each form. Fax the workers' compensation copies to the workers' compensation insurance company and MMI. 7. Create a paper file folder for these records. 8. Record the accident or illness on the OSHA Form 300 (within six days to be in compliance with OSHA regulations). 9. If the employee was treated at the hospital, arrange for him or her to visit our medical clinic for review of his or her medical condition. During the following weeks and months and until the claim is resolved, frequently contact the employee and the treating medical facility for updates on the employee and his or her treatment. 11. Check if the employee can return to work with normal or modified duties. If so, obtain a work release form from the treating physician. Legal Requirements on Timeliness of Reports According to OSHA regulations, employers are required to report to OSHA any occupational injury or illness within five days that meets either of the following conditions: v Results in lost time beyond the day of injury, or v Results in medical treatment other than first-aid. Legal Requirements on Timeliness of Reports (cont. ) Additionally, employers must immediately notify the nearest district office of OSHA if any of the following occur in relation to a workrelated injury or illness: v in-patient hospitalization for more than 24 hours, except for observation, v loss of any member of the body, v a serious degree of permanent disfigurement, or v death.
