Important Terms • SEVP: Student and Exchange Visitor Program – Part of DHS (Department of Homeland Security) – Manages schools and nonimmigrant F and M visa holders • ICE: Immigration and Customs Enforcement – Enforce immigration statutes • USCIS: United States Citizenship and Immigration Services – Oversee lawful immigration to the US • CBP: Customs and Border Protection – Manage, control and protect the US border • SEVIS: Student and Exchange Visitor Information System – A nationwide internet-based system used to maintain information on F, M and J visa holders • DSO: Designated School Official – Maintain and update student records in SEVIS for F-visa holders. 5

Obtaining Your Visa 1. Apply for a degree-seeking program at a SEVPcertified school. 2. Gain admission from SEVP certified school. 3. Obtain a Form I-20 from SEVP certified school. 4. Pay the I-901 SEVIS Fee ($350 F-visa/ $220 J-visa) at https: //www. fmjfee. com/i 901 fee/index. html 5. Schedule a visa interview at a US Embassy or Consulate in your home country. 6. Present your I-20 and obtain visa (if approved) 8

I-94 – An arrival-departure record, used by CBP, to keep track of the arrival and departure to/from the US of people who are not US citizens or lawful permanent residents • Do I have an I-94? – YES! All F & J students and dependents have an I-94 • How do I get my I-94? – – – Go to https: //i 94. cbp. dhs. gov Click Get Most Recent I-94 Click “Consent & Continue” after reading the security notification. Input all of the requested information exactly like it appears on your passport. Click “Next” • NOTE: Make sure that “Class of Admission” and “Admit Until Date” are correct. – Class of Admission: F-1, J-1, F-2, J-2 (visa type) – Admit Until Date: D/S or “Duration of Status” • Duration of Status refers to the period a student is pursuing a full course of study plus any authorized practical training following completion 10

Form I-20 • What is a Form I-20? – A Form I-20, commonly known just as “I-20”, is a document issued to the student and dependents from a SEVP-certified school (OSU). • Uses of Form I-20 – Present I-20 to US consulate/embassy in home country to get visa – Entering the US • Page 2 must be signed for travel by a DSO any time you are traveling outside of the US except for Initial Attendance I-20 s. • Travel signature is only good for 6 months from the date it is signed. – Applying for benefits • Example: Driver’s license and social security number • Keeping Form I-20 – Always keep any Form I-20 s you have together, safe and where you know they are. 13

Transfer Pending Undergraduate I-20 When a student transfers from one school to another, the new school will issue a Transfer Pending I-20. This shows that the new school has your SEVIS record. 16

Registration at ISS to Adjust to a Continued Attendance I-20 • Complete your registration at the ISS office to change from initial attendance to continued attendance I-20. • Registration should be completed within TWO Weeks of entry into the US. • The official signature on the Continued Attendance I-20 will an ISS office DSO. 17

Travel Signature • Before traveling outside of the U. Maintaining F-1 Status On-Line (internet) courses have restrictions in the full course of study per semester. You may enroll in one internet course per semester per your full course of study. Graduate Students – 9 hours = one (3 hour) internet course (6 hours classroom experience) The course is marked as WEB. Undergraduate Students – 12 hours = one (3 hour) internet course (9 hours classroom experience). The course is marked as WEB. 26

Final Semester Enrollment • You may be enrolled less than full-time – Caution: Failure to graduate results in loss of immigration status and potential loss of your opportunity for OPT. • If only one class is needed; it must be taken in class and may not be online (unless you are outside of the U. S. ) • May apply for OPT (Optional Practical Training) no more than 90 days prior to graduation date. 29

Drop and Add Hold • Drop and Add Holds will be placed on your academic record on the 7 th of class • In order to drop or add a course after the 7 th day of class you must see your academic advisor to have the hold lifted • However, if dropping or withdrawing from class(s) causes you to be under-enrolled you must visit with the ISS office for your options. • Caution: Dropping classes or withdrawing from classes can cause an issue with your immigration status 30

UNLAWFUL PRESENCE POLICY • August 9, 2018 – the unlawful presence policy changes • F-1, F-2, J-1, J-2 nonimmigrant status holders who fail to maintain an immigration status will begin accruing unlawful presence. • This means if you fail to pursue a full course of study (under-enrolled, or drop a class or work illegally) you will be accruing unlawful presence. • Plus if you remain in the U. S. after the grace period of graduation, or practical training you will be accruing unlawful presence. 32

UNLAWFUL PRESENCE POLICY • What does this mean for you as an F-1/ J -1 student? • If you are found to have been unlawfully present in the U. S. you will be barred from returning to the U. S. • The bars are: – 3 to 10 years bars depending on the amount of unlawful presence that has been accrued before departing the U. S. – Students who accrue a total of one year of unlawful presence and reenter the US could be permanently barred from the U. S. – The F-1/F-2 – J-1/ J-2 must leave the US to trigger the bar, but the bars are placed on students returning to the U. S. – If you find yourself in unlawful presence it is strongly suggested that you seek immigration legal advice. 33

UNLAWFUL PRESENCE POLICY • F’s generally do not accrue unlawful presence: • Annual vacation (Christmas, Summer holiday) • 30 period of admission before the program start date, and any authorized grace periods • While pursuing a full course of study or authorized DSO permission for a reduced course load • During Practical Training, including the unemployment periods • During change of level process • During authorized H-1 b “cap gap” period • While an OPT is pending a decision • During a school transfer process • During the time a student failed to maintain status if reinstatement application was approved. 34

Out of Status with Immigration • Upon discovery of a failure to maintain status, the student will need to consider whether reinstatement or departing the U. S. are the best options. It is strongly suggested you seek immigration legal advice prior to making a decision. The ISS will provide the documentation you need for your decision, but will not process a reinstatement. • Departing the US may not be the best option if you are subject to the unlawful presence. • Filing a reinstatement application can be risky since the processing times with USCIS can be 12 to 15 months. If the application were to be denied it could result in 3 year or 10 year depending on the processing times of the application. • Reinstatement applications will require evidence of “beyond the student’s control” as a major part of the reinstatement application. • Denials of reinstatement applications can leave the student “out of status” which could result in removal proceedings from the U. S. 35

DUI Related Offense • November 5, 2015 – Department of State – Visa Issuing Consular Office is required to revoke nonimmigrant visas for DUI arrests. • The electronic reports are sent to Department of State from the “Local/ State” and other US government agencies. If the agency determines the DUI arrest a request to revoke the nonimmigrant visa will be communicated to the student or scholar. • Communication to the student or scholar will be by a letter or email that was entered on the DS-160 application at the time of the visa application. • It is suggested that if you have this situation you travel with your DUI arrest documents. You can show the visa issuing officer or the CBP officer at the port of entry the resolution of the city/state judge’s decision. 36
