Surface Rights, Land Energy • The FAO is a resource for farmers and ranchers who are affected by energy developments. We are able to provide information on legislation and policy, advise on rights, responsibilities, negotiations and Farmers’ dispute resolution. Advocate Office
Negotiations Landowners have the right to stand their ground, however we encourage them to seek common ground with their neighbor, the energy company. Farmers’ Advocate Office
Safety and Environmental Protection • Consistent conditions noted in approval: – Weed Control: prohibited and noxious weeds – Soil Integrity: pre and post testing – Access to ROW for construction – Landowner use and enjoyment of land: Crossing – Standard conditions for all landowners, not the “best negotiators” – Transparency in compliance monitoring and Farmers’ Advocate reporting Office
Participant Funding Program • Funding is necessary for landowners during negotiations, not only during the hearing process: Advisors/Lawyers/Consultants • Create a less intimidating process to submit an application for funding • Clarity and consistency on intervenor status • Adequate funding to complete all necessary work Farmers’ Advocate Office
Public Participation • Broaden the scope of who can participate in NEB hearings (Standing); directly affected by a proposed project or have relevant experience • Offer sufficient participant funding to be effective • Consider the approach of a lifecycle regulator and continue consultation past project approval • Create “Consultation Best Practices” for all stages of the project Farmers’ Advocate Office
