Political Climate: Undocumented Students DACA California Dream Act ■ Since it was installed as an executive order, it can be rescinded via executive order at any time by the President of the United States. ■ President Trump has expressed that he will deport 11 million undocumented immigrants. This increases the fear of deportation for undocumented students and their families. ■ AB 540, AB 131, AB 2000 & SB 1210 are California state laws and require consideration in a public educational settting. © Juarez Consulting Inc. ■ California education leaders have pledged to fight to keep all aspects of the DREAM Act in place. ■ The state might find itself in direct conflict with the federal government.

Campus Setting FERPA is the Family Educational Rights and Privacy Act and is a federal law that was enacted in 1974. FERPA protects the privacy of student education records. All educational institutions that receive federal funding must comply with FERPA. Rights at the postsecondary level belong to a student ‘in attendance’ (regardless of age) and former students. Education Code: Section 67381 requires that the written agreements identify either the campus or local law enforcement agency as having operational responsibility for the investigation of Part 1 violent crimes, and that they delineate the specific geographical boundaries of each agency's operational responsibility. Assembly Bill 913: The Kristin Smart Campus Safety Act of 1998 - Upon the governing board of a community college district adopting a rule requiring its campuses to update these agreements, the bill would subject the community college district and its campuses to the requirements imposed on other postsecondary institutions by the bill. The bill would encourage the governing board of each community college district to adopt a rule requiring its respective campuses to update these agreements. By expanding the duties of community college districts and local law enforcement agencies, this bill would impose a state-mandated local program. Assembly Bill 2792: The Truth Act - all records relating to ICE access to jail information will now be public records under the California Public Records Act, which acts as an accountability measure to enforce the other protections of the TRUTH Act. It also ensures that California communities have oversight over their local law enforcement agency’s relations with ICE. © Juarez Consulting Inc.

Consideration for admissions ■ AB 540: It allows undocumented students to attend colleges and universities in the State of California and pay tuition of State residents Requirements: ■ Having attended a high school in the State of California for 3 years or more and/or attending a primary school ■ Graduating from a high school in the State of California or obtain a certificate of equivalence of general education (GED) ■ Agree to modification legal status in the United States. © Juarez Consulting Inc. Outreach needs to be on the same page ■ AB 2000: To obtain credits from a school of California equivalent to three or more years of full time high school courses AND a total of three or more years of attendance at a primary school in California, California secondary school, or a combination of these schools. This refers to the eligibility for AB 540, stops pay state tuition at community colleges in California and the University of the State of California, and the right to benefits under the DREAM Act of California.

Office of Financial Aid State Law: AB 130 & 131 Assembly Bills 130 & 131 are laws that were passed in 2011 by the California legislature. This law increases opportunities for AB 540 students to receive financial aid while attending college. State Law: SB 1210 In September 2014 the governor established the California DREAM Loan Program. Ø The bill would provide that, commencing with the 2015– 16 academic year, a student attending a participating campus of the University of California or California State University may receive a loan, referred to as a DREAM loan, through the program if the student satisfies specified requirements, including a requirement that the student be exempt from paying nonresident tuition or meet equivalent requirements adopted by the regents. © Juarez Consulting Inc.
