CONSTITUTIONAL COMPROMISES AND PRINCIPLES
WHY IS THE US CONSTITUTION IMPORTANT? The Constitution is the supreme law of the land. § If there is ever something that disagrees with the constitution, it is wrong.
CONSTITUTION VOCABULARY Living Constitution- term used to describe the Constitution’s flexibility. Amendment- a change made to a document (like the constitution) Bill of Rights- A list of guaranteed freedoms. 1 st 10 Amendments.
INTERPRETING THE CONSTITUTION Expressed Powers § Article 1 contains a list of Congress’ powers. Necessary and Proper Clause § Article I says “to make all Laws which shall be necessary and proper” § “implied powers” Loose vs. Strict interpretation § Loose interpretation is like saying “ I know its says this but it really means this” § Strict interpretation is like saying “ It says this and absolutely means this”
COMPROMISES
CONSTITUTION PLANS Virginia New Jersey Bicameral legislature (2 house law making body) with the number of representatives based on population. Unicameral legislature (1 house law making body) with number of representatives based on equal representation. Strong National Government with 3 Branches Strong National Government with 3 branches.
GREAT COMPROMISE Bicameral Congress § 1 House based on Population (House of Representatives) § Virginia Plan § 1 House based on Equal Representation (Senate) § New Jersey Plan
CONSTITUTIONAL COMPROMISES Three-Fifths Compromise § Voting Power and taxation would be based on population. § For every 5 slaves, 3 would count.

POPULAR SOVEREIGNTY Government power comes from the people!!!
LIMITED GOVERNMENT The Government is not all powerful and can only do what the people let it do.
SEPARATION OF POWERS Helps prevent one branch from becoming too power. (Montesquieu)
CHECKS AND BALANCES Gives powers to different branches that allow them to keep other branches from getting too powerful.
