889 Background • Section 889 of the 2019 National Defense Authorization Act (NDAA) incorporated

889 Background • Section 889 of the 2019 National Defense Authorization Act (NDAA) incorporated prohibitions on procuring from several Chinese based companies • Telecommunications • Video surveillance equipment products and services • Part A of the Section 889 law has been around for a while. • Clause prohibits purchasing such equipment and services to be used in the performance of the contract. • Part B was effective August 13 th and goes a giant step further • Prohibits entering into, extending or renewing a contract [including purchase card transactions] with an offeror that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system 3

P-Card Prohibition • Agency has reactivated approximately 20% of 1700 p-card holders who have taken the required 889 training allowing them to purchase products and services necessary for mission essential/critical operations of the center. • All purchases must be approved as mission critical/mission essential by the Associate Center Director. La. RC has published procedures for process and AD is reviewing requests twice a week with exceptions for urgent requirements. • Plan is to audit p-card documentation, and make decisions to continue to reactive p-card holders slowly

NASA Framework for Return to On-Site Work (as of 9 Sept. 2020) Stage 4 Gating Criteria Established by White House, OPM and OMB to increase on-site work. * This guidance applies to NASA civil servants. Contractor employees should reach out to their management. Stage 3 ↓ trajectory of COVID-like syndromic cases AND influenzalike illnesses reported in a 14 day period. Stage 2 ↓ trajectory of documented cases in a 14 -day period OR ↓ trajectory of positive tests (as % of total tests) in 14 -day period - Mandatory telework Stage 1 Robust testing in place for healthcare workers, including antibody testing, AND local hospitals able treat patients without crisis care and capacity not exceeded AND adequate PPE available to execute missions safely where social distancing is impractical. -Employees who must be on-site to - Full access. - Facility is closed, except to mission-essential 3 personnel - On-site work is limited to mission-essential 3 and approved mission-critical 2 work. perform their work may return onsite with center/supervisor approval. - All other employees will continue to telework. - Mission-critical 2 visitors only and with approval. - Telework is encouraged for employees who can accomplish their work remotely, with supervisor approval. Mission critical: work (on NASA activities or those supporting our federal agency partners) that needs to be performed to minimize the impact on mission/project operations and/or schedules and cannot be performed remotely/virtually. 3. Mission essential functions: As described in the COOP, during an emergency, NASA’s Primary and Mission Essential Functions (P/MEFs) must be continued with minimum interruption and are focused on protecting life and property as well as insuring agency leadership and control of the agency.

Return to On-Site Work Key points from Center Director email this morning: • We remain in Stage 3 of the Framework for Return to On-Site Work (RTOW) and continue to actively monitor COVID-19 related metrics at the federal, state, and local level. • Based on the current landscape, we do not anticipate a formal transition to stage 2 until sometime into the new year. A decision on the transition to stage 2 will be made after careful consideration of the COVID-19 metrics and our ability to adhere to agency health and safety guidance. • We are implementing a new process, known as RTOW 2. 0, for approving on-site work that will allow for the safe and gradual increase of work on the center. The process allows for personnel who must be on-site to perform their work the ability to return on-site with appropriate center and supervisory approval. All other personnel will continue to telework. This approach will allow for a smoother transition to stage 2 when we are ready to make that decision. • RTOW 2. 0 gives organizational directors the authority to approve on-site work projects by using our established processes for planning and scheduling work, ensuring facility readiness and conforming to the COVID-19 safety and health protocols. • To minimize risk, we are requiring that masks be worn inside all buildings and facilities on center. An exception will be made if an employee is working by themselves in a closed office, however all other exceptions must be reviewed by the Safety & Mission Assurance Office. Additionally, continue to monitor the health and safety guidelines. Recent additions include Safety and Health Requirements; Respirators, Masks and Face Coverings; and updated RTOW Frequently Asked Questions. • Continue visiting La. RC SOS periodically, especially if you are planning to come on center, for the latest information and guidelines.

When there are on-site cases or other concerns, OP will continue to provide that information to contractors who have employees who have returned to on-site work
