Facts About UW 1. One condition for being a UW is that a waste be a hazardous waste; 2. Federal UW regulations are found in Title 40 Code of Federal Regulations Part 273; 3. Texas UW regulations are found in Title 30 Chapter 335, Subchapter H, Division 5; 4. Except for most hazardous waste batteries, managing qualifying hazardous wastes as UW is optional but not required.

Categories of Universal Waste - 5 Categories (1) Batteries described in 40 CFR § 273. 2 Batteries must be intact. It does not include spent lead-acid batteries when managed under 30 TAC Chapter 335, Subchapter H, Division 4. (2) Pesticides described in 40 CFR § 273. 3 Only pesticides that have been recalled or come from stocks of unused products gathered as part of a waste pesticide collection program are classified as UW.

UW Management Benefits When managing UW, Handlers are not required to: • Count UW towards your HW generation status; • Identify UW on your NOR; • Report UW on you annual waste summary; • Except for P&PR UW going out-of-state, manifest the waste; • Use a registered waste hauler within Texas; • Pay a hazardous waste generation fee on UW; or • Ship UW off site within 90/180 days (UW may be kept on site for up to one year).
