Updates • Last week additional waivers – #44 Extended summer waivers until first day of school or 9/30 which ever first – #45 Extended summer meal flexibility 9/30/2020 – #46 Extended summer site eligibility 9/30/2020 – #47 Extends parent/guardian pickup 9/30/2020 for summer and school lunch

Terms • USDA Waiver Extension – Extending is sometimes modifying the original waiver. • Guardian – Person responsible for well being and financial responsibility of a child.

FFVP • Maine has waiver for FFVP site eligibility and child/parent pick up • With waivers, schools have the following options for serving FFVP: – FFVP can be served outside of the regular school day or with other Child Nutrition program meals (breakfast or lunch). This also means FFVP can be sent home. – If doing meal pick up or delivery, the parent/guardian can pick up/receive FFVP alongside other meals – FFVP can be distributed from another school in the district, other than elementary schools. For example, if a central kitchen is used. – If providing multiple days meals at one time, multiple servings of FFVP can be provided (also in bulk). This may be helpful for those operating a hybrid method.

Waivers and Extensions • USDA extensions are sometime modifications – Original meal Pattern waiver included milk, not the extension – Vegetable sub-groups could not be waived in the original but now it is possible with justification

Local Waivers Needed from State Agency • Forms on the Lunch page under Management Forms – We have grouped things together • Waivers are needed to track for USDA reporting and keep everyone on same page.

Local Waivers needed from State Agency • Multiple Meal Distribution Request - to provide more than 1 day worth of meals but max of 5 days • Waiver to Allow Non-congregate Feeding - If meals are being taken offsite • Meal Times Flexibility – If serving meals at a time not outside of regulations • Parent/Guardian pickup - If parent/legal guardian is picking up the student’s meal • Alternative Serving Locations - If meals are being served/accounted for in an alternate location

Local Waivers needed from State Agency • Meal pattern waivers include all parts of the meal pattern. – Requests can be made under conditions • Keep I mind: Nutrition standards for each program must be kept to the greatest extent possible. Districts must maintain any relevant documentation to support this requests.

Summer Waiver Extensions • Whichever comes first, first day of school or September 30 th • Non-congregate, site eligibility and meal time flexibility waivers all still apply • Split starting days in the district high school in August and elementary in September for example.

Going back to Unanticipated Closure • Do go back to summer in September – School must be out for 5 days no instruction

P-EBT • August 20 th extension • Maine does not qualify – All schools must offer lunch

New Maine Laws • Breakfast After the Bell – No corrective action plans required currently – We have posted the required information to indicate what schools need to look at the law – Will not contact anyone until November – Staffing is an issue here at DOE

Court Decision • Center for Science in Public Interest CSPI vs Sonny Perdue – Court found procedural error with promulgation • Final rule flex for milk, Whole Grains and Sodium • Vacated rule • School Meal patterns return to 2012 – No fat flavored milk – 100% Whole Grain – Target 2 of Sodium • Nationwide waiver would apply here
