Staff Recommendation Approval with 8 Special Conditions: Staff is recommending eight special conditions, which require: 1) no future shoreline protection device and removal of development under specific circumstances if threatened; 2) assumption of risk; 3) future development requires a permit amendment or new permit; 4) the applicant’s recognition and support of the dune restoration plan required under CDP 5 -19 -0067 and prohibition of future encroachments; 5) conformance with the submitted drainage plan, including that site drainage will be directed to sediment basins located at the landward side of each side yard; 6) implementation of construction best management responsibilities; 7) protection of any public rights that exist or may exist at the subject site; and 8) recordation of a deed restriction against the property referencing all of the special conditions imposed by the Commission.
