Task Force • Membership – 21 Community Members – Balance of Pro, Con and Neutral – Two Ex-Officio Members – Commissioners Vinci and Wolf • Very Compressed Time Frame • Over 700 Volunteer Hours • • Four 3 -hour meetings Four 6 -hour meetings Prep and follow-up time Steering Committee • External Facilitation • Heroic Staff Work • Recommendations – – 3/27/2015 Land Use Code and Municipal/“Programmatic” Code Much Consensus, Some Majority, Some Unanimity Considerable Compromise Strong Minority Positions rsw 3
PC Recommendations Intro • Land Use Code Recommendations Only • Programmatic TF Recommendations Referenced for Implementation / Operational “Mechanics” • Compressed Time Frame – One working session w/ Staff & TF Steering Committee – One Public Hearing / Deliberation Meeting – One Continuation Deliberation Meeting • Multi-faceted, Very Complex – Insufficient time to gain full understanding of issues & alternatives – No PC Consensus but Recommendations Supported by Majority • Four “Yay”, Two “Nay”, One Absent 3/27/2015 rsw 4
PC Modifications • Modifications to TF Land Use Code Recommendations – Only Apply Concentration “Option One” • 7. 5% within 250’ (TF recommended 5% to 10%) • Option Two too complex (included Neighborhood Density) – No Neighborhood Association Meeting prior to Application – Type II if STR ≥ 30 days / yr (TF ≥ 20 days) – Approval Modification Review of a Remodel Only if Bedroom Added (TF recommended 50+% remodel) – Others Modifications Considered but No Majority Opinion 3/27/2015 rsw 5
Challenging Topics • Property Rights - Oregon Land Use Regulations (Measures 49 & 37) • Concentration Limits at 7. 5%? – Consider less density ? • Only one / 250’ ? • Do not permit any in Residential Zones • Treatment of MR zone same as other Residential zones • Conduct Neighborhood Association meeting before application • Enable a subdivision (or phase) to have different requirements than underlying zone • < 30 Day Condition for Type I Review • Abandonment of Use Conditions • Significant reduction of concentration in Old Bend and River West unlikely in the near term • Does “one size fits all” apply uniformly to entire City? 3/27/2015 rsw 6
Possible Follow-up • Analyze results after several vacation seasons to determine the impact of the new code and evaluate if modifications are required • Consider inter-relationships – – – Short Term Rentals vs Long Term Rentals Rental Effect on Density and Infill Rental Effect on Affordable Housing Rental Effect on OSU Housing Rental Effect on UGB • Follow-up Recommendations Summarized by Commission Chair, Bill Wagner 3/27/2015 rsw 7
Summary • VHR/STR is a very complex topic with no simple answers to multi-faceted issues • PC applauds the efforts of the Task Force – – • • Tremendous effort by volunteers Thoughtful and mostly sound recommendations Herculean effort by City Staff Vast majority of Land Use Code recommendations endorsed by PC Programmatic Code needed to support Land Use Code Concentration is in excess in two neighborhoods Immediate action required to manage future rentals Follow-up efforts recommended 3/27/2015 rsw 8
