Summary of Proposed Rule This rulemaking action will: • Eliminate the requirement for operators to apply for RVSM authorization when an RVSM compliant aircraft is equipped with ADS-B Out • Recognizes the enhancements in altitude-keeping performance monitoring resulting from the use of ADS-B Out systems • Responds to requests to eliminate the burden and expense of the current RVSM application process for operators Federal Aviation Administration 3
Regulatory Requirements • 14 CFR § 91. 180 and § 91. 706 remain unchanged • Will amend Appendix G of 14 CFR part 91: – Add a new Section 9 (Operations in RVSM Airspace with ADS-B Out) for aircraft equipped with ADS-B Out • RVSM equipment standards unchanged; • Must have ADS-B Out meeting the requirements of 14 CFR § 91. 227; • Must have the aircraft’s altitude-keeping performance monitored in a form and manner acceptable to the administrator; and • Altimetry System Error (ASE) can not exceed 200’ Federal Aviation Administration 4
Regulatory Requirements (cont. ) – Retain and Revise Section 3 (Operator Authorization): • Recognize operators may choose to operate under the provisions of new Section 9. • Retain specific authorization for those operators that – – are not equipped with ADS-B Out; – do not routinely operate in ADS-B monitored airspace; or – when a foreign country requires specific approval Note: ICAO Annex 6 – Operation of Aircraft, parts I and II, requires specific approval for RVSM. When operating outside U. S. controlled airspace, an operator will need to seek specific approval via operations specification, maintenance specification or letter of authorization, as applicable, until such time that ICAO guidance is amended. Regulatory Requirements (cont. ) – Revise Section 4 (RVSM operations) to require all pilots to have knowledge of RVSM requirements, policies and procedures sufficient for the conduct of RVSM operations – Revise Section 8 (Airspace Designations) to eliminate detailed airspace designations of RVSM airspace, recognizing world-wide application of 1000 feet separation between FL 290 – FL 410. – Revise Section 1 (Definitions) accepting that RVSM is a standard operation – Additional conforming amendments to Section 5 (Deviation Authority Approval), and Section 7 (Removal or Amendment of Authority) to support the addition of new Section 9 when aircraft operate in RVSM airspace without specific authorization Federal Aviation Administration 6
