Unfair dissmisal – what does it mean?
• UNFAIR – we do not agree with grounds of being dismissed • DISMISSAL - the employer dismisses the employee; Dissmissal = being fired = being sacked
Eligibility to claim unfair dismissal • Employees can only claim unfair dismissal if they’ve worked for a qualifying period - unless they’re claiming for an automatically unfair reason. • Who can’t claim unfair dismissal • for example: • self-employed people • independent contractors • members of the armed forces
When the dismissal is unfair? • Your dismissal could be unfair if your employer doesn’t: • have a good reason for dismissing you • follow the company’s formal disciplinary or dismissal process • Situations when your dismissal is likely to be unfair include if you: • asked for flexible working • refused to give up your working time rights - eg to take rest breaks • needed time off for jury service • applied for maternity, paternity and adoption leave
Automatic unfair dismissal There are some reasons for dismissal that are automatically unfair • If your employer dismisses you for exercising or trying to exercise one of your statutory (legal) employment rights you will have been automatically unfairly dismissed. • • • An employee's statutory employment rights include a right to: a written statement of employment particulars an itemised pay statement parental leave the right to request flexible working arrangements not to be discriminated against because of your gender, race, disability, religion or belief, political opinion, sexual orientation or age guaranteed pay when work is not available for you time off for public duties (for example, jury service) time off to look for work or make arrangements for training prior to redundancy time off for study or training • •

What to do if you're dismissed If you’re threatened with dismissal (or are dismissed) you can get help from a third party to solve the issue by mediation, conciliation and arbitration. You can also speak to your union representative if you’re a member of a trade union.
Employment tribunals If you’ve been unable to solve a problem between you and your employer, you can normally go to an employment tribunal. In unfair dismissal claims you must make the claim to a tribunal within 3 months of being dismissed.
