Enterprise Agreement 2013, Section 29. 1 – ‘It is agreed that, under no circumstances, will any employee affected by alcohol and/or affected by any other drug be permitted to commence/continue working, or operate any equipment, on Company projects or whilst engaged on another project. Enterprise Agreement 2013, Section 29. 4 – ‘It is agreed that the Company’s employees will adhere to a zero (0) alcohol level whilst working. • There are various types of tests that the company and/or client will perform: – A Drugs of Abuse Urine Test – A Drugs of Abuse Tongue Scrape Test – A Breathalyser Test Created 11/07/2015; Rev 1 Toolbox Talk 013 – Drugs and Alcohol 7
• A Drugs of Abuse Urine Test will be conducted by the client (i. e. Emergency Management Officer), general practitioner, hospital or police station. • The test can be undertaken: • randomly if requested by the client/ Austral • ‘For Cause Testing’ (i. e. the worker is under reasonable suspicion that they are under the influence of illicit or foreign substances) • ‘Post-Incident Testing’ (i. e. workers involved in an incident should be tested for illicit or foreign substances) • ‘Pre-Employment Medicals’ (i. e. worker provides a urine sample prior to commencing work with Austral Construction) Created 11/07/2015; Rev 1 Toolbox Talk 013 – Drugs and Alcohol 8
• A Drugs of Abuse Tongue Scrape Test will be conducted by Austral, the client (i. e. Emergency Management Officer), general practitioner, hospital or police station. • The test can be undertaken: • randomly if requested by the client/ Austral • ‘For Cause Testing’ (i. e. the worker is under reasonable suspicion that they are under the influence of illicit or foreign substances) • ‘Post-Incident Testing’ (i. e. workers involved in an incident should be tested for illicit or foreign substances) Created 11/07/2015; Rev 1 Toolbox Talk 013 – Drugs and Alcohol 9
• Alcohol tests, or BAC tests, will be conducted using Austral’s calibrated breathalyser units prior to each shift commencing (‘Pre-Start Testing’) • Workers will conduct the test themselves using the provided device and mouthpiece • Basic operating instructions are as follows: Press ENTER to switch on Attached mouthpiece to spigot Press ENTER to perform test When instructed, blow gently into mouthpiece until sample is taken – Unit will indicate satisfactory sample taken – BAC will be displayed – – Created 11/07/2015; Rev 1 Toolbox Talk 013 – Drugs and Alcohol 10
• Alcohol tests, or BAC tests, may also be conducted by Austral, the client (i. e. • Austral/Client ‘For Cause Testing’ and ‘Post. Incident Testing’ will be conducted by competent people – For a Drugs of Abuse Urine Test you will be escorted to the medical office by your supervisor or delegate (site only). You will wait there until you have provided your specimens. – For a Drugs of Abuse Tongue Scrape Test you will be escorted to a private secure room with your supervisor or delegate. You will wait there until you have provided your saliva. – For a Alcohol tests, or BAC tests, you will be escorted to a private secure room with your supervisor or delegate. • Austral/Client ‘Pre-Employment Testing’ will be conducted by competent people – For a Drugs of Abuse Urine Test you will be required to attend a pre-determined medical clinic. – For a Drugs of Abuse Tongue Scrape Test you will be required to attend a pre-determined medical clinic. – For a Alcohol tests, or BAC tests, you will be required to attend a pre-determined medical clinic. Testing Process • A refusal to submit a sample (saliva, breath or urine) for testing will be considered a positive result. • Appropriate steps will be taken to ensure privacy and confidentiality for the person being tested, as far as is practicable. Disciplinary consequences up to and including termination of employment will apply for the following: • Consumption or Possession of Alcohol or Other Drugs in the Workplace • Sale or supply of Alcohol or Illegal Drugs in the workplace or during working hours • Breach of a Statutory Duty • Tampering, Substitution or Adulteration of Test Samples • Serious Misconduct Created 11/07/2015; Rev 1 Toolbox Talk 013 – Drugs and Alcohol 16
The first positive result • You will be counselled by your leader • You will be required to provide satisfactory evidence that you have addressed the issue that led to the positive result. This will be in the form of a clear Drug and Alcohol Laboratory test and a letter from your General Practitioner stating you are fit for work • Your fitness for work will be monitored for 3 months during which time periodic testing (unannounced and/ or planned) will occur • You will be required to speak with our EAP provider • Depending on the severity of the issue, you will receive a written warning and may have your employment terminated. The second positive result • You will be counselled by your leader • You will be required to provide satisfactory evidence that you have addressed the issue that led to the positive result. This will be in the form of a clear Drug and Alcohol Laboratory test and a letter from your General Practitioner stating you are fit for work • Your fitness for work will be monitored for 6 months during which time periodic testing (unannounced and/ or planned) will occur • You will be required to speak with our EAP provider • You will receive a second written warning and may have your employment terminated.
