Legal The ISPS Code was approved by the government of Brunei Darussalam and falls under the Ministry of Transport and Info Communications. The Regulation amended the Shipping (Ship and Port Facility Security) Regulations, Merchant Shipping Order, 2002 (S 27/02) of Merchant Shipping (Safety Convention) (Amendment) Regulations, 2004, Chapter XIA Special Measures To Enhance Maritime Security. The Shipping Regulations applies both Part A and Part B of the ISPS Code as Mandatory Requiment. The enforcement for ships is the responsibility of Maritime Enforcement Division MPABD The enforcement for Port Facilities is the ISPS Unit MPABD

Role of the Institutions Members of auditors have been appointed permanently to implement and enforce the Code 24 hour contact VTS Signal Station to receive notice of Ship arrival information Port security auditors are assigned to port facilities based on schedule as the DA representative on security issues and to ensure drills, exercises, audits are completed and ports remain compliant with Code Port Security committees are set up at all ports Administration for Ships ensures ships maintain ISPS Compliance through inspections by authorised personnel
