First Amendment l l l The 5 freedoms protected by the First Amendment are: Speech Press Religion Assembly Petition the Government
Second Amendment A. The right to keep and bear arms. l There is a debate about this. l One group believes that this means that each state has a right to have a militia. l The other group believes that it means citizen has the right to bear arms. l
The Third Amendment l A. This Amendment states that “in peacetime, ” soldiers may not move into private homes without the consent of the homeowner.
The Fourth Amendment A. Protects Americans “against unreasonable searches and seizures. l Law enforcement officers must have a search warrant to search your possessions. l
The Fifth Amendment l A. Protects the rights of the people accused of a crime. l B. Person must be indicted on a crime to go to court. l C. Protects against Double Jeopardy. l D. Protects right to remain silent. l E. A person must have due process of law. l F. Gives Government Eminent Domain.
The Sixth Amendment l A. Gives additional due process rights. l B. Accused must be told the charges against them. l C. Trials must be speedy and public and jurors must be impartial. l D. Must be held in the same district where the crime took place. l E. Accused has right to question and hear all witnesses.
The Seventh Amendment A. Protects citizens in Civil Cases (disagreements between citizens on contracts etc. ) l B. Guarantees a jury trial for a civil case when the amount being disputed is over $20. 00. l
The Eighth Amendment A. Protects against excessive bail and fines. l B. Protects against cruel and unusual punishment. l
The Ninth Amendment A. States that citizens have other rights that goes beyond the Constitution. l Example: Right to privacy. l
The Tenth Amendment l A. States that any powers the Constitution does not specifically give to the national government are reserved for the states or to the people. l Prevents Congress and the president from becoming too strong.
