Testamento n El testamento (del latín testatio mentis, que significa "testimonio de la voluntad"). El testamento es un documento que permite repartir los bienes a la muerte de su propietario. Se respeta siempre, salvo si conculca los derechos de los herederos forzosos y se puede revocar o modificar cuantas veces sea preciso.
What is a Last Will and Testament? n Put simply a Last Will and Testament is a way for you to comunicate your wishes from beyond the grave. n More formally it is a legally enforceable statement of your wishes regarding matters to be attended to after your death and not operative until you have died. It is usually but not always relating to property; revocable (or amendable by means of a codicil) up to the time of his death or loss of mental capacity to make a valid will. n Part of the document specifies who is going to handle the instructions you have left. This person (or persons or company) is known as an Executor.
n n Another part of your Last Will and Testament tells the executor how to split up your estate (everything you own). The most important factor that determines whether a Will is legal or not, is the way that it is signed and witnessed. Other features that you may wish to include in a Will (or Last Will and Testament) are specifying guardians for your children - if you have any that are young enough to need guardians. You can also include details about your funeral.

Falta de univocidad Todo testamento necesita ser interpretado. La aparente claridad de las palabras no exime al intérprete de investigar cuál era la verdadera voluntad del causante. El albacea debe ceñirse a los rigurosos límites formales del testamento. Jueces, notarios y abogados deben enfrentarse cotidianamente a la difícil labor de dar a las palabras del testador el sentido que éste deseaba expresar con ellas.
La redacción de un testamento en España El testamento es una declaración legal en 3ª persona. El testamento debe ser redactado por un abogado. Ninguna persona debe redactar su propio testamento por más pequeños que sean sus bienes.

Conclusion To sum up, concerning legislation the Spanish testament offers a more protective approach towards the legal succesors, but in the English one the testator can exclude his descendants. n Although the procedures are different, the purpose is the same, fulfilling the testator’s wishes after his death. n
