Task 2 unit 4, 5, 62 Contractual brief & Tender brief & commission brief & Formal brief & Informal brief & competition brief negotiated brief & cooperation brief
Design Brief • A design brief is a written document for a design project developed in concert by a person representing the business need for design and the designer. The document is focused on the desired results of design – not aesthetics. Design briefs are commonly used in consulting engagements, when an independent designer or a design agency executes a design on behalf of a client. They are less common when the designer is in-house.
CONTRACTUAL BRIEF • A Contractual Brief is a legal document, which is created between an employee and a client. • The layout of a contractual brief is very easy and clear to read, meaning it allows the client to complete their details without confusion. • A Contractual brief outlines the duties that will be required by the company, and how the company organizes their work. • A contractual Brief is legally obligatory and what is prescribed and outlined must be followed. an example would be an actor and a film making company as an actor is legally bound into doing what ever is agreed on the contract like the amount of films they must act in
Advantage of contractual brief • There are multiple advantages to a contractual brief that can benefit both the client and the production company; some of these are as follows. In a contractual brief there is a guarantee of the agreed parameters for both parties of the contract, this ensure that neither party can breach the agreed contract without legal consequences. This contract can also benefit the production company as it means that they fully understand exactly what needs to be done, this is because the contract will be very detailed in what the client requires which gives the production company a detailed understanding.
Agreement
Disadvantage of contractual brief • There are however some disadvantages to a contractual brief, these disadvantages mainly apply to the production company, for example a contractual brief can be too controlling for the production company as it doesn’t allow any room for creative freedom, this can cause the production company to be unenthusiastic about the product they are producing and consequently the product may be of an unsatisfactory quality for the client. As well as this, a contractual brief can also take a long time to negotiate; this can cause problems as it takes a large time of both client and Production Company’s time additionally to delaying the start of the production if negotiation takes time.
Tender Brief • A client will produce an advertisement stating that they require a media product to be created. • A potential employer, such as a production company, initiates a brief, a budget, as well as a proposal, which is then pitched to the client in order to secure their chance of obtaining the work that was previously advertised by the employer. • The client decides upon the most impressive proposal featured from their group of candidates. An example would be people pitching to a advertiser for ideas for an advert.
Advantage of tender brief • Some of the advantage to using this type of brief is that the client has access to a number of different idea that they not have first thought of , and of these they can choose between them or have the opportunity to build in aspect of these different brief to create a product that you want.
Disadvantage of tender brief • However the disadvantage of using this type of brief of could be for the companies that we wanting the project because not all the of these companies that have applied will get the job
Commission Brief • A commission brief is where a large corporation, such as The Daily Mail, employ an independent company to create their product/project for them. It is notable that this type of brief is negotiated between two media companies, as opposed to an external client, who may receive the product once it has been established.
Example
Example
advantage of commission brief • This work well for the independent company because they are getting paid for doing there job as well as the chance to have a share in the profits made by the company meaning they are ending up with a healthy profit. In eyes of the company it work well for them too because it means that they have the time to work on other project at the same time as they don’t have to be so involved in project
Disadvantage of commission brief • The company doesn’t get such an active role in the design making for the product and so they could be end up with something very different to what they expected. You may have to also share out profits with other investors and share holders in the business meaning the profits that you get is a lot less than what you might have first expected
Formal brief • A formal brief is where a production company is given a brief by the client that details the product they want produced, the content of the brief is agreed between the two parties beforehand details only what is wanted within the production and nothing else. A formal brief often doesn’t cover legal issues within the brief and therefore can be risky for the client if the production company were to not conform to legal guidelines. A formal brief can be negotiated and used within larger groups and audiences; this makes it more applicable to large production teams than a contractual brief.
Example
Advantage of Formal Brief • Formal briefs have multiple advantages for both parties, for example it is an easier contract to read and understand than others, this is because it is all written in a formal style so that both the client and the production companies can fully understand what is required. As well as this a formal contract is one that is easily discussed with a larger group meaning that the contract is suitable for large production teams or a group of clients. A formal contract is beneficial to both parties in the way that it isn’t complicated making it an easy contract to form compared to others and once the contract is agreed by both parties, no amendments or changes can be made, this can be beneficial as it prevents either party being victim to the other not following to their agreed parameters of the brief.
Disadvantage of Formal Brief • this kind of brief also has multiple drawbacks, one such example is it doesn’t always cover legal issues, this means that it is risky for both parties if one decides to infringe a legality and consequently bringing the other party difficulty. One other disadvantage is that the contract cannot be changed or altered once agreed, this means that the production company cannot make changes to what they can do as stated in the contract once it is signed. As a result of this, if the production company cannot do what is stated in the contract then they will not be able to meet the requirements of the contract.
• Formal- This type of brief is a written document like a contract containing very accurate details about what needs to be achieved and sometimes how to achieve what the document is presenting, you would never find extra unneeded information on a formal brief. This type of brief is often aimed a groups of people than an individual for example a university course will explain exactly what the course is about and what is needed in order to be accepted.
Informal brief • An informal brief is one that is agreed entirely through informal discussions between client and production company, therefore there is no written evidence of a brief being agreed at all. As a result of this, an informal brief is based purely on trust between the two parties to uphold their end of the agreement. In order to form an informal brief the parties will have numerous quick meetings to discuss what each party wants, notes will be made so that the production company knows what they are doing before the parties agree verbally on all decisions discussed, a handshake may be shared between the client and production company to show the bond of trust.
Example
Advantage of informal brief • An informal contract has many advantages due to it having no written contract such as there being no strings attached, this means that if either party cannot uphold or meet their end of the brief then there are no consequences, this benefits the production company because if they cannot do something which they may have previously agreed they could, the client has no proof to the agreement. As well as this an informal brief means that the meetings are short resulting in more production time and less time agreeing to a brief, ideas can be change whilst mid-production which gives the production company more creative freedom to experiment new techniques and produce something more interesting for them.
Disadvantage of informal brief • there are many disadvantages, for example there is no contract involved in an informal brief, this means that there is no detailed written evidence of what is required by the client or of what is given by the client as budget and payment, this means that the production company can be cheated of payment. As well as this the fact that the brief as all based on verbal agreement, this means that there is no written evidence should either party go to court. Informal briefs are also considered to be unprofessional and since no written evidence can be made during meetings, the production company may forget important guidelines regarding the production they need to make.
Cooperative Brief
Cooperative Brief Within this type of brief there are usually two or more companies that are hired by the client to work to the brief they have written for the specific project they re wanting to be completed. After both companies have received the brief they can then proceed to work together to produce the product. If there is a disagreement or conflict in ideas there can be a negotiated brief in order to resolve these issues.
Advantage of Cooperation Brief • Advantage of having a cooperation brief would be that you have to more people on the product meaning more ideas to bounce from each business. Also you have much more room from for delegation and can provide the tasks to much more employees, thus meaning getting the product created of time if not before schedule which would please the client
Disadvantage of Cooperation Brief • Disagreement would be one disadvantage to having two different business but also the payment, having more people would mean that you would pay a lot more for the product to be done and may get the same outcome from just one party alone.
Competition Brief
Competition Brief • This is where a client can put their brief out so it can be accessed by all of the different production companies that are participating. It can sometimes been seen as a free competition as each production company will complete the brief and the client can then judge which company has the best project and as an award they have it published.
Advantage of competition brief • An advantage for the company is that most of the time these type are projects become available thought competition or advertisings and the wining ideas is given or paid in cash which can work out cheaper for the company then any other way. As well as the fact that the company can take other have make there projects for nothings without prizes or being paid
Advantages of Competition • • • Greater productivity. Better quality of work. Delivery of work on time. In other words deadlines are met. A work-oriented staff. Higher profits.
Disadvantage of competition brief • However, it means that after all that work put into each production company only one will get chosen and paid meaning the others have make there projects for nothings without prizes or being paid.
Disadvantage of Competition Brief • Too much stress. • Work pressure affects health of employee. • The employee may not be too sympathetic towards his or her employees as he or she may be interested only in results. • Team spirit may get affected as each employee would be suspicious of the other person’s motives. • Unhealthy competition. One employee bringing down another employee through malpractices in order to supercede the person.
Negotiated Brief • A negotiated brief is when two or more companies come to together to negotiate ideas about a project. When negotiating through the contact, they don’t stop the discussion until they have an agreement altogether. The brief is all about going through the contract so that everything is fair between both parties and the client, it allows new ideas to come forward for the project so that it can be the best quality. When negotiating they would have to make sure that ideas they produce are in the legal guidelines, if they broke any of this then might get sued.
Advantage of Negotiated Brief • This helps to let you knows what you are doing and what has been improved e. g. theme and visual aspects of the project. This means both of the companies and client can really grasp on what they want and need. Another advantage of a negotiated brief is that when you negotiate your ideas with one another then it means that there will be less conflict but strong solutions. When negotiating through the contract , it helps to find news economic deals, this is because if they discuss about spenditure etc. then they might find better ways to save money. By negotiated ideas with the client it means that you get to see a wider picture of what they want and have a better understanding.
Disadvantage of negotiated Brief • A disadvantage of having a negotiated brief that you can discuss about certain subjects too much, this can be quite draining and it wouldn’t help you to get to the bottom of your problem. When both parties are negotiating about the contract then they might forget about the best deals that can come from a contract. Instead the two parties just agree on a idea because they have been talking too much. Which means they don’t agree on what they want altogether.
