History and Purpose • • 2008—State legislation was passed requiring the State of Maryland to work with local governments to develop a Statewide Base Map with digitally generated, georeferenced 1, 000 foot Critical Area boundary. Baltimore County and Talbot County were selected as pilot project areas. April 2008 to March 2013—Critical Area Commission, Department of Natural Resources, Maryland Department of the Environment and county staff worked to develop methodology, standards, and regulations for delineating the shoreline and edge of wetlands. December 2010—Three public information meetings held (two at Easton, one in St. Michaels). Property owners that had a 50% or greater change in the area of their property in critical area received a letter from the Commission, 218 letters. March 2011—Additional public information meetings held in Easton and St. Michaels. Property owners with any increase in acreage of their property in critical area were notified, 1, 445 notices mailed. Citizens and property owners participated in interactive sessions with State and local staff. 2010 -2012 Critical Area worked on state legislation to address mapping regulations, growth allocation, etc. November 2010, June 2011, and February 2012—County staff took review points to the Planning Commission for guidance. March 2013—Summary Draft Maps delivered to Talbot County formal adoption within 24 months. 1/8/2022 Talbot County Planning and Permits 2
Proposed Text Amendment § 190 -136. Lot Coverage F. For lots of record located wholly or partially outside of the 1, 000 -foot Critical Area boundary prior to (date of adoption) that are wholly or partially within the Critical Area due to adoption of the Statewide Base Map update, lot coverage shall be limited to 15% subject to the following exceptions. For lots ½ acre or less in size: (1) Lot coverage may not exceed 40% for an unimproved lot. (2) Lot coverage may not exceed 40% for legally developed lots. A legally developed lot with more than 40% lot coverage shall be legally nonconforming as of (date of adoption) for purposes of lot coverage requirements.
