Introduction to Document (p. 1) n Provides history and data on the importance of Syringe Access & Disposal Programs (Syringe Programs) n States a clear purpose of the document: n “to provide a framework that summarizes best practices based on public health strategies” n Defines the terms: n n ‘must’ – indicates a mandatory practice required by law or by Departmental directive. ‘should’ – indicates a strongly recommended practice. 2

Authorization of Syringe Programs (p. 3) n This section provides the history and process of authorization: n 2001: California Assembly Bill (AB) 136 n n n Created State of Emergency and H&S Code Section 11364. 7 Protected local government organizations, their employees, and authorized subcontractors from criminal prosecution for distribution of syringes in jurisdictions that declared a local health emergency. 2005: The law changed to allow counties and cities to authorize SPs in their jurisdictions without declaring a state of local emergency and provided a process for the California Department of Public Health to set regulations to support local health jurisdictions. 5
