|Suruhanjaya Komunikasi & Multimedia Malaysia| PROVISIONS UNDER CMA 1998 Sec 211 • Prohibition of offensive content which is defined as “content which is indecent, obscene, false, menacing or offensive in character with intent to annoy, abuse, threaten or harass any person”. Sec 232 • Fraudulent use of network services, etc. Sec 263 11 facilities, • General duty of licensees to assist in preventing the commission or attempted commission of an offence under the Laws of Malaysia.
|Suruhanjaya Komunikasi & Multimedia Malaysia| SPECIAL LICENCE CONDITIONS ON CONTENT Local content requirement, including language quotas (varies depending on licensee) Requirement to provide news Restrictions on prohibited content and requirement to comply with the Film Censorship Act: Prior approval is required for live and delayed broadcast Commercial advertisements- max 10 minutes/ hour a) shall not provide any content which may upset the sensibilities and sentiment of any race or religion in this country Requirement to allocate at least 2 minutes per broadcast hour for Public Service Announcements and Government messages Others -programmes that promote Malaysian culture and national identity b) Shall not provide any content which contains cultural and moral values that are against the community aspirations of the nation 12

Broadcasters to leverage on the Internet to promote their existing Internet TV/portals & to develop more portals promoting their content to the public Copyright owners cooperation in identifying breach of copyright 14
