STATUS OF THE IMPLEMENTATION OF THE IPID ACT AND SUGGESTED AMENDMENTS CHAPTER AND SECTION CHAPTER 1 STATUS OF COMMENTS IMPLEMENTATION DEFINITIONS, OBJECTS OF ACT, ESTABLISHMENT, INDEPENDENCE AND IMPARTIALITY Section 1 Definitions Proposed changes “SSA” means ”State Security Agency” “Torture” as in section 3 of Prevention of Combating and Torture of Persons Act 13 of 2013 Section 2 “Security Clearance certificate” means an official document issued by the Executive Director to a person that has successfully undergone security clearance by the SSA Objects of Act Implemented Section 3 Establishment Fully Implemented Section 4 Independence and impartiality Implemented Still reliant on SAPS resources (laboratories), independent investigator qualification, Integrity of crime scenes (Expansion Strategy) 3

STATUS OF THE IMPLEMENTATION OF THE IPID ACT AND SUGGESTED AMENDMENTS CHAPTER AND SECTION CHAPTER 6 Section 22 Appointment of investigators STATUS OF IMPLEMENTATION COMMENTS APPOINTMENT, REMUNERATION, FUNCTIONS AND POWERS OF INVESTIGATORS Implemented Section 22(2)(a) delete “…at least grade 12 certificate or…” Section 22(3) delete “Minister” add “SSA” Section 22(4) replace “National Intelligence Agency” with “State Security Agency”. Replace “section 3” with “section 2 A”. Replace the referred Act with “National Strategic Intelligence Act 39 of 1994” Section 22(5) “security screening certificate” should read “security clearance certificate” delete the words from “security clearance” up to the end of the sentence. After the “security clearance” insert the words “as prescribed by the SSA” 9
