Current Status • Master Plan submitted to the City of Rio Rancho by Land Development 2, LLC on August 3, 2020. • The Master Plan was recommended for denial on September 22, 2020. • The denial stated that, “The explanation of open space ownership and maintenance is inadequate. ” Southern Sandoval County Arroyo Flood Control Authority (SSCAFCA)
CORR P&Z Open Space Deficiencies • The master plan should provide a mechanism, such as a conservation district, to ensure the open space is dedicated to be open space in perpetuity. • The land developer must establish and identify the owner, the association, or nonprofit corporation prior to the sale of any lots. Lack of Agency Interest • No Public agencies have shown interest in accepting the Open Space – City of Rio Rancho – Sandoval County – The Nature Conservancy • No Private golf course or other private open space entity has shown interest in developing the open space. CORR Open Space Uses • • Natural areas designated for outdoor education, low-impact recreation, wildlife/habitat enhancement and conservation, natural and cultural resource preservation; Land undergoing restoration; Regional preserves; Lakes, waterways, flood water storage areas, and other public facilities for handling flood water, all designed in such a way as to be considered a visual and/or physical amenity in the community; Land that serves as a buffer, protecting the public from natural hazards; Structures and facilities incidental to the above uses; provided, that such incidental buildings do not cover more than five percent of the ground area; Amenities and improvements supporting the above uses including drinking water fountains and spigots, trash and dog waste receptacles, tables and benches, bicycle racks, and regulatory and interpretive signs; Unpaved service roads, permeable parking lots with 25 spaces or less, fencing six feet in height or less, trails and trail corridors, and public utilities necessary for the protection, development and use of the open space area. Flood Control/Drainage • Preservation as Open Space removes need for additional drainage infrastructure. • Ponds surrounding the Enclave and East Lakes Subdivision can serve adequately as drainage retention ponds. • Routine pond maintenance will be required in perpetuity. • Development within the Golf Course property can increase flood risk.
