Regulations and Responsibilities Official Use Requirement "Official use" is defined as the employment or authorization of employment of a government motor vehicle (owned, leased, or rented, if required) in the discharge or performance of an official duty, function, or service. AR 58 -1, ch 2, para 2 -3 provides guidance for determining whether certain events have an official purpose and meet the “official use” criteria. Use of government motor vehicles by military personnel for other than official purposes is a violation of Article 92 of the Uniform Code of Military Justice (UCMJ). Financial liability may be assessed against Soldiers of the Army (including members of the Army Reserve and National Guard) and DAC employees when Government property is lost, damaged, or destroyed, as a result of their negligence, willful misconduct, deliberate unauthorized use, or failure to operate the vehicle in a safe manner in accordance with applicable traffic safety laws. Depending on facts and circumstances, the criminal sanctions of 18 USC 641, may apply to the misuse of a Government NTV. The statute provides for a fine or imprisonment for up to 10 years or both. 4
Regulations and Responsibilities Operator’s Identification Card A valid motor vehicle license issued in any of the 50 states, the District of Columbia, Puerto Rico, or similar licensing jurisdictions will be sufficient qualification for military and civilian personnel to operate commercially-designed, general purpose vehicles up to 1 1/2 -ton cargo trucks. Personnel who operate vehicles in excess of 14, 000 pounds gross vehicle weight (GVW) must possess a Department of the Army (DA) Form 5984 -E (Operator's Permit Record) (see Figure 1 -2), or an Optional Form (OF) 346 (US Government Motor Vehicle Operator's Identification Card) 5

Regulations and Responsibilities Licensing Requirements Driving off the installation within the US or US possessions, operators must have the following: A valid DA Form 5984 -E (OF Form 346), valid civilian driver license issued by a State, the District of Columbia, or a US possession (Virgin Island, Puerto Rico, or Guam). Driving on the installation within the US or US possessions operators must have a valid DA Form 5984 -E (OF Form 346). If the operator does not have a civilian license they may be issued a military license at the commander’s discretion. License must state for on post only under the restrictions. If an operator has a civilian license that has been suspended or revoked for any reason, they will not be issued a military license or their current military license will be suspended. Operator may be issued a military license after their civilian license has been reinstated and the commander has reviewed documentation and approved the operator to have a military license again. Driving outside the United States possessions operators must have a valid DA Form 5984 -E (OF Form 346), and meet any additional host nation and major Army commander requirements. 8
Regulations and Responsibilities Qualification Record DA Form 348 (Equipment Operator’s Qualification Record (Except Aircraft) provide the means for recording the complete history of your driving qualifications and equipment-operating experience. Required for each equipment operator, DA Form 348 reflects qualifications, experience, performance, and test results. For complete information concerning maintenance of DA Form 348 (see AR 600 -55 and DA Pamphlet 750 -8). 9

Regulations and Responsibilities Authorization Form Your authorization form to operate a military vehicle is the your vehicle dispatch. In order to operate any military vehicle you must be licensed on the equipment and dispatch the equipment. Vehicle dispatch is specific to the vehicle listed on the dispatch. You may not use the dispatch to operate another vehicle just because they are the same model. 14
Regulations and Responsibilities Operator Qualifications To be a military or civilian operator, you must— • Be qualified and licensed. • Be physically, mentally, and emotionally stable. • Be informed about vehicle and local traffic laws. • Have sound knowledge of driving techniques. • Have sufficient experience, evidenced by good safety habits and driving skills. • Have a courteous and responsible driver attitude. 15
Regulations and Responsibilities Operator Responsibilities As a vehicle operator, you are responsible for the following: • Safely operating your vehicle and complying with applicable federal, state, local, and HN laws and regulations. • Conducting before-, during-, and after-operation inspections of your vehicle. • Following all operator maintenance outlined in the appropriate vehicle technical manual(TM) (Army) or technical order (TO) (Air Force). • Caring for and cleaning your vehicle and its equipment at all times. • Ensuring the safety and comfort of your passengers (includes ensuring that seat and shoulder belts are fastened). The senior occupant will ensure that passengers comply. • Ensuring the security of the vehicle and cargo entrusted to you. • Exercising common sense. • Notifying your supervisor or noncommissioned officer (NCO) of any change in your status (for example, inability to drive due to physical condition or withdrawal of your state operator's license). 16
Regulations and Responsibilities Review • Military vehicles to include NTVs are only allowed for “Official Use” • All Soldiers assigned to drive a military vehicle must be licensed properly IAW Army regulations and local laws and policies. • In order to operate a military vehicle Soldiers must be licensed on and dispatch the vehicle. • Operator Qualifications • Operator Responsibilities 17
Regulations and Responsibilities CONCLUSION • As a vehicle operator, your responsibility and liability are far more extensive than you may have originally thought. Understand that operating any type of equipment (large combat equipment or small wheeled vehicles) carries with it the responsibility associated with liabilities and potentially life-changing situations. • REMEMBER: Operate your equipment in a safe and prudent manner at all times! 18
