WHAT THE LAW SAYS ? CIDB’s Act 520 (Amendment 2011) • Section 33 C(1) : ‘The Lembaga shall, in the manner determined by the Lembaga, certify the construction materials used in the construction industry and specified in the Fourth Schedule in accordance with the standard specified in the Schedule. ’ • Section 33 D(1) : ‘A person shall not deal or undertake to deal, whether directly or indirectly, with the construction materials specified in the Fourth Schedule unless the construction materials have been certified by CIDB. ’

WHAT THE LAW SAYS ? CIDB’s Act 520 (Amendment 2011) • Section 33 D(2) : Any person who deal or undertake to deal with the construction materials specified in the Fourth Schedule without the certification of the Lembaga shall be guilty of an offence and shall, on conviction, be liable to a fine of not less than RM 10, 000 but not more than RM 500, 000. ’ • Section 35 C(2)(a) : Search and seize any construction materials, equipment, instrument, book, record, document, computerized document, article or other thing that is reasonably believed to furnish evidence of the commission of such offence

SUMMARY v Act 520 (Amendment 2011) empowered CIDB to regulate construction materials produced locally

SUMMARY v Act 520 (Amendment 2011) empowered CIDB to regulate construction materials produced locally through certification process. v Enforced construction materials shall be listed in the Fourth Schedule of Act 520 (Amendment 2011). v Quality Products must conform to Malaysia Standard (MS) v Any person who ‘deal’ with uncertified materials shall be liable to a fine of not less than RM 10, 000 but not more than RM 500, 000. ’ v PPS will only be issued to manufacturers that have Product Certification (PC) v PC must be issued by accredited CB which recognized by Jabatan Standard Malaysia or CIDB , e. g. SIRIM, IKRAM v PPS is valid for ONE YEAR and need to be renewed.
