EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 1. Citation and commencement. a) These regulations may be cited as the Education (Parent - Teacher Association) Regulations 1998. b) These Regulations shall come into force on 26 March 1998. 2. Application. These Regulations shall apply to government school and government-aided school.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 3. Interpretation. In these Regulations, unless the context otherwise requires --- "office-bearer" means� --a) any person who has been nominated and elected in the annual general meeting by the members of the Parent -Teacher Association; or
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 b) any member appointed by the President to replace a committee member of the Parent Teacher Association who died or resigned before the next annual general meeting; or c) any person appointed to be a committee member of the Parent - Teacher Association by the District Education Officer or the Division Education Officer or the Registrar (for a State which has no District Education Officer or Division Education Officer) by the powers provided under these Regulations;
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 "Parent - Teacher Association" means an association established under regulation 4; "school" for the purposes of these Regulations means government school and government-aided school.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 4. Establishment of Parent - Teacher Association. 1) There shall be established in every school an association to be named as the Parent - Teacher Association (hereinafter referred to as "the Association") consisting of – a) all the teachers teaching in the school; b) the parents of the pupils attending such school; and c) the Head Teacher or the Principal of the school as an ex-officio member and the Association's Adviser.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 2) Malaysian citizen who has no children or custody attending such school but is interested to be a member of the Association may apply to be a member either to the District Education Officer or the Division Education Officer or the Registrar (for a State which has no District Education Officer or Division Education Officer).
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 3) Every parent and teacher in the school shall be deemed to be a member of the Association. 4) For the purposes of these Regulations, the Association is not a society within the meaning of any law relating to the registration of societies.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 5. Purposes and limitations of the Association. 1) The purposes of the Association shall be�: a) to provide a forum and service for the welfare and development of the pupils in the school in upgrading the image of the school; b) to assist and increase the effort of the school in meeting the material requirements and needs of the pupils in their activities;
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 c) to enable parents and teachers in the school to exchange ideas and information on education d) to give opportunity to the parents and teachers in the school to consult each other as to the manner of improving the standard of education of their children in general; and
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 e) to enable parents and teachers in the school to strive to increase the finance of the school and upgrading the physical facilities for the purposes of upgrading the teaching and learning facilities.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 2) The activities of the Association shall be directed to the welfare and development of the pupils in the school where the Association is established.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 3) The Association may, with the permission of the Head Teacher or the Principal promote curricular and co-curricular activities inside or outside school, by utilizing the skilled and specialized manpower from amongst members or non-members of the Association for the purposes of upgrading the academic achievement or the overall progress of the pupils.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 4) The Association shall be allowed to collect any contribution which is determined in the annual general meeting from members and the Registrar shall be notified of the decision. 5) The Association shall not extend the Association's jurisdiction to matters connected with the administration of the school, the employment and conditions of service of teachers and other staff in the school.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 6) The Association shall not be the machinery for the settlement of disputes or other related matters as between the Association and the Head Teacher or the Principal or the staff of the school where the Association is established or the District Education Office or the Division Education Office or the State Education Office or the Ministry of Education or the State or Federal Government.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 6. Organization and management 1) The Association shall be established by the Head Teacher or the Principal in every school. 2) The Association shall be managed by a committee in accordance with the constitution of the Association. 3) The committee shall comprise of not less than five and not more than fifteen members who are elected in the annual general meeting of the Association.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 4) Without prejudice to the generality of subregulation (2), the District Education Officer or the Division Education Officer or the Registrar (for a State which has no District Education Officer or Division Education Officer) may appoint not more than two individuals who are non-members to be committee members.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 5) The individuals mentioned in subregulation (4) shall be persons who have integrity, interest and proven to be able to contribute positively to the development of education. 6) The District Education Officer or the Division Education Officer shall obtain the approval of the Registrar in respect of the appointment made under subregulation (4).

Registration of the Association. 1) Where an Association has been established by a Head Teacher or the Principal, he shall submit to the Registrar an application for registration of the Association as contained in the First Schedule 2) The Head Teacher or the Principal shall submit together with the application a copy of the draft of the constitution of the Association which shall provide the matters specified in the Second Schedule
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 3) The Registrar may, upon being satisfied that an application for registration having been duly made, register the Association and issue a certificate of registration as contained in the Third Schedule.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 8. Right of Registrar to attend meetings. The Registrar or his representative shall have the right to attend all meetings of the Association.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 9. Power of the Association to possess property, etc. The Association shall have the power to possess, use and dispose of any of the Association's moveable or immoveable property which in the Association's opinion is to facilitate the Association in the proper exercise of the Association's powers and duties under these Regulations.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 10. Fund audit 1) There shall be established and managed by the Association a fund into which shall be paid all donations or contributions from any member towards the purposes of the Association. 2) The Association shall keep or cause to be kept proper account and other records in respect of the Association's operation and shall also cause to be prepared statement of account for each financial year.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 3) The account of the Association shall be audited annually by two persons who are non-committee members and who shall be nominated and elected by the members of the Association. 4) The Association with the consent of the annual general meeting shall be allowed to obtain the service of an accredited auditor for the purposes of auditing the Association's account.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 5) The Head Teacher or the Principal shall be allowed to inspect the account of the Association.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 11. Administration. 1) The Head Teacher or the Principal of the school where the Association is established shall assist the clerical and stationery needs of the Association. 2) All other needs of the Association other than those mentioned in subregulation (1) shall be the responsibility of the Association.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 12. Power of Registrar in relation to exercise of functions, etc. 1) If the Registrar is satisfied, either upon a complaint or otherwise that an Association or the members of the Association--a) have been acting or are proposing to act unreasonably with respect to the exercise of any power conferred or the discharge of any duty imposed by or under these Regulations or by the constitution of the Association; or
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 b) have failed to discharge any duty imposed upon the Association or members of the Association by or under these Regulations,
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 the Registrar may�--(aa)give such directions in writing as to the exercise of the power or the discharge of the duty as appear to the Registrar to be expedient, with which directions it shall be the duty of the Association or members of the Association to comply; or
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 (bb) suspend or dismiss all or any of the officebearers of the Association and, notwithstanding the provisions of any regulations or the constitution of the Association, appoint such person or persons as the Registrar may think fit to have and to exercise all the functions of the office-bearers of the Association for such period as the Registrar may direct.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 2) If at any time, for an Association in any school there is no office-bearer, the Registrar may appoint such person or persons as the Registrar may think fit to exercise the functions of the office- bearer of the Association for such period as the Registrar may direct.
EDUCATION (PARENT-TEACHER ASSOCIATIONS) REGULATIONS 1998 13. No affiliation with bodies outside the school. The Association shall have no affiliation with any political party or trade union or other organization or association registered or incorporated under any written law in force relating to it. 14. Revocation. The Parent - Teacher Association Rules, 1973 is revoked.
