THE REAL ESTATE PURCHASE - PROCEDURE In Jamaica, the Offer to Purchase IS NOT the Agreement for Sale. An Attorney who represents the Seller prepares an Agreement for Sale and the Purchaser’s Attorney vets it. Once both Attorneys are satisfied with the draft it is presented to their clients for their input. Purchaser signs Agreement and pays deposit to his/her Attorney Seller signs Agreement and Attorney forwards it to Govt. Stamp Office to be Assessed for Tax Purchases. The transaction costs are paid to the Government and the documents are stamped. The Transfer Document is prepared and signed by both parties once Purchaser presents proof of ability to pay the balance.
THE REAL ESTATE PURCHASE - PROCEDURE Once the documentation is completed and balance of payment is secured ( in the form of a commitment letter from a Bank or other lending institution, Undertaking from Purchaser’s Attorney or Escrow Company), the Sellers Attorney then sends the Agreement for Sale, Transfer Document and the Title to the Government Titles Office for ownership to be transferred. The government Titles office guarantees a 30 day turnaround time, however for an US$85 expedite fee this process can be reduced to 3 -5 days. Sellers Attorney then calls the balance of payment and the Title is handed over (along with the keys to the property, if applicable) to Purchasers Attorney once payment is made.
REAL ESTATE TRANSACTION COSTS Below are guidance notes on the cost schedules for Vendors and Purchasers in a property sales transaction and are subject to variances in legal fees between attorneys acting for each party. Stamp duty: 4. 5% of sale price (vendor and purchaser pay ½ each) Registration: 0. 50% (vendor and purchaser pay ½ each) Transfer Tax 5. 00% of sale price (vendor pays solely) Legal Costs: 2. 00% to 3% plus GCT for Cost of Sale (depends on attorney) Mortgage Closing Costs: Approx. 6%

RAJ members are affiliated with the National Association of Realtors (NAR) here in the USA and properties displayed on our MLS automatically are displayed on Realtor. com, the leading website for property searches in Jamaica. Industry standard for commission paid on a Real Estate Sale in Jamaica is 5% plus gct, total $5. 82. This is very close to that typical paid in Florida which is 6%. Real Estate commission and Attorneys fees are negotiable. Note that it is the Law that gct be collected on all fees.
