RULES prescribing prescriptions for medicines and medical products I. General requirements for prescribing prescriptions for medicines and medical products 1. Recipes for medicinal products and medical products (hereinafter referred to as "Recipes") are issued by doctors of business entities conducting economic activity in medical practice (hereinafter referred to as "the subject of management"), in accordance with the medical specialties under which medical practice is carried out in accordance with the received license, and according to the medical positions (hereinafter - medical workers). Recipes for medicines, medical products, which are released on preferential terms, free of charge or with an additional payment, or the cost of which is subject to state compensation (in whole or in part), in addition to prescriptions for medicinal products subject to reimbursement, issued through the electronic health care system physicians who provide primary health care, in accordance with the legislation of Ukraine, are allowed to be issued to medical workers of the business entities conducting medical practice, in agreement with the structural idrozdilamy local health administrations.

Physicians of health care establishments, irrespective of their forms of ownership and subordination, have the right to issue Recipes for patients with protracted and chronic illnesses in case of continuation of the course of treatment by the treating physician, indicating their position and certifying the Recipe with their own signature and the seal of the health care institution.

2. Health care workers who have the right to maintain Recipes are responsible for the appointment of patients and donor rules. In case if the recipe was issued in violation of these Rules, the head of the health care establishment or the individual entrepreneur (hereinafter - FOP), conducting economic activity in medical practice, is obliged to ensure timely education of the new Recipe for the patient.

3. Recipes are issued to the patient in the presence of appropriate indications with mandatory record of the appointment of medicinal products or medical products in medical documentation (history of the disease, medical card outpatient or inpatient). Recipes are issued for medicines registered in Ukraine, except for cases stipulated by the current legislation. 4. Recipes must be written out for: prescription drugs; over-the-counter medicines, medical products in case of release them free of charge or on preferential terms; Medicines that are manufactured in a pharmacy for a particular patient.

5. Recipes for medicinal products, except for narcotic (psychotropic) medicines, and medical products shall be prescribed on the formulas No. 1 (ф-1) (Annex 1). Recipes for narcotic (psychotropic) medicines in pure form or in a mixture with the indigenous substances are prescribed on special formulas № 3 (ф-3) (Annex 2). Special form recipes form № 3 (ф-3) are made on a pink paper of 75 × 120 mm in size, having a sequential numbering. The control over their accounting and use rests with the responsible person, who is appointed by the order of the economic entity.

Recipes of f-1 and f-3 can also be issued in the form of an electronic document - an electronic recipe. An electronic recipe is created, stored and transmitted through an information (information and telecommunication) system, access to which is provided to authorized persons of the business entity, who execute the electronic prescription, and to authorized persons of the business entity, who issue the medicinal product by electronic recipe accordingly to the requirements of the current legislation in the field of electronic document circulation, electronic digital signature and information security in information and telecommunication systems.

An information and telecommunication system in which an electronic recipe is created, stored and transmitted, must have an integrated system of information security with verified compliance. An electronic recipe is issued in accordance with paragraph 1 of this section authorized by the person in the information (information and telecommunication) system of the subject of business by imposing a qualified electronic signature of a medical worker in accordance with the legislation on electronic document circulation and electronic trust services. {Paragraph six of clause 5 of section I as amended: Order of the Ministry of Health № 634 dated March 22, 2019}

A recipe created by a computer kit that was printed and signed by yourself or by facsimile is not considered an electronic recipe. An entity independently decides on the introduction of electronic prescriptions, except when the requirements for mandatory electronic prescription are determined by law. In order to write an electronic recipe, the entity submits information about the doctor and the patient to the database of information (information and telecommunication) system, which corresponds to the information indicated on the prescription forms of forms No. 1 (ф-1) and № 3 (ф-3).

An electronic recipe for the patient can be created, transmitted, stored and converted by electronic means in a visual form that reproduces the information indicated on the prescription forms of forms No. 1 (ф-1) and № 3 (ф-3). The visual form of an electronic recipe is to display the data it contains, electronically or on paper, in a form suitable for perceiving its contents by a person. This form is not a recipe. With the consent of the patient, the entity may provide additional services (services) related to the electronic recipe (recipe notification via mobile means, e-mail address, etc. ).

6. Recipes for medicinal products released under preferential conditions, with surcharge or free of charge, except for narcotic (psychotropic) drugs, are issued in 2 copies on the form for the form No. 1 (ф-1) (except for electronic prescriptions). 7. In case of donation, free of charge, with an additional payment or on preferential terms of narcotic (psychotropic) medicines, besides the prescription of the Recipe on the form ô-3, an additional recipe is issued on the form ô-1.

8. If necessary, in accordance with the dose regime, it is permitted to prescribe the Prescription for a medicinal product in the amount necessary for the continuation or repetition of the course of treatment, indicating the multiplicity of the delivery of drugs, except for medicinal products released in accordance with the rules for the release of prescription medicines (hereinafter referred to as the norms leave) (Annex 3). 9. It is prohibited to prescribe medicines in one Reception in a larger quantity than specified in the rules of release, except for the following cases: specified in clauses 3, 4 of section II of these Rules; the receipt of the prescribed medicines in the original packaging containing more tablets than indicated in the marketing standards.

10. It is prohibited to issue Recipes for medicinal products (according to international non-proprietary names), listed in Annex 4 to these Rules, which are used for all types of anesthesia (inhalation, non-inhalation, administration) during surgical and diagnostic interventions. 11. Reciprocating drug products containing narcotic drugs, psychotropic substances or precursors in quantities not exceeding their maximum permissible norm are prescribed by medical personnel on the prescription forms of the F-1. It is prohibited to prescribe f-1 combinations of drugs in one of which the amount of narcotic drugs, psychotropic substances or precursors exceeds the maximum number specified in Annex 5 to these Regulations. In the case of receipt of these drugs in original packages containing narcotic drugs, psychotropic substances or precursors in excess of their maximum permissible norm, it is allowed to prescribe 1 package of the medicinal product, but not more than 50 tablets.

12. Recipes for medicinal products, prescribed on the formulas № 1 (ф-1), valid for one month from the day of issue, and on special formulas № 3 (ф-3) - within ten days from the day of issue. The validity period of the electronic recipe corresponds to the validity period of the Recipe written on the form of the form No. 1 (ф-1) and the form of the form No. 3 (ф -3), respectively.
