504 Plan vs. IEP - What’s the Difference? 504 Plan ● Part of the federal civil rights law that prohibits discrimination against public school students with disabilities ● Goal is to remove physical barriers to access ● Includes: ○ ○ ○ specific accommodations, supports or services Name of school professional that will provide each service Name of the person responsible for ensuring the 504 plan is implemented
504 Plan vs. i. EP - What is the Difference? Individualized Educational Plan (IEP) ● Plan for special education services within the school ● Requirements: ○ ○ Students must have at least 1 of 13 specific qualifying disabilities listed in the Individuals with Disabilities Education Act (IDEA) Disability must affect the student’s educational performance and/or ability to benefit from general ed curriculum ● Guarantees fair and appropriate education in the least restrictive environment
504 Plan vs. IEP - What is the Difference? Individualized Educational Plan (IEP) ● Who MUST be included in IEP development: ○ ○ parents/guardians At least one general ed teacher School psychologist Others invited by team ● IEP plan generally includes: ○ ○ ○ Annual educational goals Services that the student will receive with start date or duration specified Accommodations to the school/learning environment Modifications to academic program Plans for standardized testing Plan for inclusion in general ed program
Making Changes to 504 or IEP plans 504 Plan ● Parents should be notified of any significant changes to plan, does not have to be in writing ● Generally reviewed annually, required review every 3 years IEP ● Requests for changes must be made in writing before changes can occur ● IEP team is legally required to review the IEP annually ● Student must be re-evaluated every 3 years
Other Important Information to Know ● Services provided through 504 Plans or IEP plans are provided at no charge ● Both plans allow for use of assistive technology ● Recommended School Accommodation Considerations: ○ ○ ○ Physical Therapy - stretching, safety training, adapted/modified Physical Education Occupational Therapy - Assistive Technology evaluation, modified written assignments School Accommodations - additional set of text books, preferential seating, Emergency Evacuation Plan ● Private school tuition must be covered by the public school district if the public school district fails to provide an appropriate education ● Schools must provide an RN if the child needs one to attend school
