Greenhouse Gas Plan • Testified in 2007 to be “net carbon neutral” • Claimed 1 -to-1 reduction in imported water • MWD contract prohibits reduction for desalination • Poseidon AWARE • Purchased Climate Action Reserve offset credits • Poseidon submitted 2013 permit with SAME PLAN – later withdrew

Marine Life Mitigation Plan • Approved in 2011 by the Coastal Commission • 66 acre wetlands restoration in South San Diego Bay • USFWS has not approved design • Still no environmental studies or final project design

Chronic Toxicity • 2 Notices of Violation: – Failures to comply with discharge prohibitions – Failures to comply with receiving water limitations – Failure to comply with effluent limitations – Failure to monitor in accordance with permit provisions • Exceeded daily maximum toxicity limits on 19 occasions

Chronic Toxicity • Exceeded chronic toxicity limits in 35 out of 116 – 30% - in 2016 • 5 chronic toxicity violations in 2017 • 9 deficient monitoring violations in 2017 • Toxicity evaluation inconclusive after 18 months

Public Trust State Lands Commission must protect the Public Trust… – Permit compliance – Pollution abatement – Water quality – Marine Life … and investigate Poseidon’s chronic toxicity violations.
