Welsh Parcel (Special Conditions 9, 10, 11) • Existing Highway • Existing highway easement will terminate after highway use is no longer needed (deed: “right of way and incidents thereto for said State Highway. . . ) • Cannot dedicate fee interest or easement, Caltrans does not own the land • Rights are limited to the operation of the Highway • Caltrans is not transferring or selling any state land • Proposed Right-of-Way • Caltrans has obtained an order of possession of the proposed right-of-way that includes a strip of land approximately 130 to 142 feet wide across Welsh parcel • Caltrans has begun eminent domain process to acquire the County of San Luis Obispo’s interest in scenic/conservation easement over proposed right-of -way • Ongoing eminent domain litigation • Caltrans cannot agree to conditions that require actions to be taken on land that it does not own • Caltrans will agree to work with Coastal Commission, State Parks and other agencies toward mutually beneficial uses should opportunities arise regarding 9 the Welsh parcel after completion of litigation
