How to infringe on a Patent. Physical Property - You must “step on” someone’s physical property to “encroach” on it. Intellectual Property (Patent) – Your invention must “read on” (step on) all the elements of at least one independent claim in order to “infringe” (encroach) on someone’s else’s patent.
