How Much Rent Can I Charge? The Maximum Lawful Rent for existing tenants is determined by adding together the following three components: Maximum Allowable Rent (MAR) + Registration fee pass-through + Allowable surcharges_____ = Maximum Lawful Rent Santa Monica Rent Control Board 7
What is the MAR? § The MAR is the base rent plus any allowable increases. § Annual increases are per General Adjustments § The addition of certain amenities may also result in allowable increases. Maximum Allowable Rent (MAR) + Registration fee pass-through + Allowable surcharges_____ = Maximum Lawful Rent Santa Monica Rent Control Board 8
How Is the Base Rent Determined? • Pre-1/1/99 Tenancies The base rent is usually the rent in effect on April 10, 1978. • Post-1/1/99 Tenancies The base rent is usually the initial rent charged at the beginning of each new tenancy. Santa Monica Rent Control Board 9
What Determines the Amount of the Annual General Adjustment (GA)? • The GA is based on 75% of the annual change in the regional inflation rate; however: • The Board retains the authority to apply a fixed dollar-amount maximum increase after holding a public hearing. • The GA is limited to between 0% and 6%, to reduce the impacts of deflation or hyperinflation. • In 2018, the GA was 2. 9% with a maximum of $60. • The Board announces the GA in June each year. Santa Monica Rent Control Board 10
When Can a GA be Taken? The GA may be used to increase rents as of September 1 st of each year (or anytime after) only if: • • • all registration fees and any penalties are paid; the tenancies and property are properly registered; there are no uncorrected citations or notices of violation of health, safety, or housing laws for the unit or property; there is substantial compliance with the Rent Control Law; the owner gives proper written notice of the increase; and the tenancy has been in effect for over 12 months (i. e. , before the previous September 1 st). Santa Monica Rent Control Board 11
How Can I Learn the MAR for a Controlled Unit? • Call, e-mail or come to the Rent Control office during business hours. An Information Analyst will answer your questions. • Use the “Look Up A Rent” link on the Rent Control website to learn the MAR for a unit. • Each year, the Agency sends property owners a MAR Report indicating the MARs in the Agency’s records. The report is designed to assist owners in preparing the annual rent increase notices to tenants. Santa Monica Rent Control Board 12
What is the Registration Fee Pass-Through? • For controlled units, an annual Registration Fee is charged to property owners by the Board (unless a fee waiver has been granted). MAR + Registration fee pass-through + Allowable surcharges_______ = Maximum Lawful Rent • The property owners pay the annual fee to the Rent Control Board. • If registration fees are paid in full by the due date (usually August 1 st), owners may include in their tenants’ rents a monthly surcharge equal to half of the monthly per-unit fee. The current fee is $16. 50, and half of that is $8. 25. Santa Monica Rent Control Board 13
Registration Fee Waivers • Low-income elderly and low-income disabled tenants may apply for a registration fee waiver for their units. • Owners may apply for a registration fee waiver for units occupied by Section 8 tenants. • Owners holding at least a 25% interest in a property and occupying a unit as their principal place of residence may apply for a fee waiver for their unit. • If a fee waiver is approved, registration fees are not charged for the unit and there can be no registration fee pass-through charged to a tenant of the unit. Questions Santa Monica Rent Control Board 41
How Does the Rent Control Law Affect Evictions? • The reasons for terminating a tenancy are limited. • Termination notices served on tenants for most types of evictions must be filed with the Agency. • Evictions for owner occupancy are subject to a number of limitations and requirements. • The passage of Measure RR in the election of 2010 added further restrictions on evictions. Santa Monica Rent Control Board 42
What Are the Allowable Reasons for Terminating a Tenancy? • Tenant-fault evictions: The Rent Control Law allows evictions for certain situations where the tenant is at fault. Such grounds include non-payment of rent or violating an important condition of the rental agreement. • No-fault evictions: Evictions are also allowed for very limited situations where there is no tenant fault, such as for an owner to occupy a unit or to go out of the rental housing business. For most “no-fault” evictions, relocation benefits must be paid to displaced tenants. Santa Monica Rent Control Board 43
Notices of Termination of Tenancy Must Be Filed with the Board • This requirement applies to termination for any reason other than failure to pay rent. • The notice must be filed with the Board within three days of service on the tenant. • Failure to file with the Board can be used as an affirmative defense in an eviction action. Santa Monica Rent Control Board 44
What Kinds of Limitations Are There on Evictions for Owner Occupancy? • Owner must be a natural person with at least 50% ownership. • Owner or specified family member must intend to move in within 30 days of the date the unit is vacated and occupy the unit as a primary residence for at least one year. • There are penalties for failure to owner-occupy in good faith. (continued on next slide) Santa Monica Rent Control Board 45

(continued on next slide) Santa Monica Rent Control Board 46
What Kinds of Limitations Are There on Evictions for Owner Occupancy? • Tenants of TORCA condominium units who are “Participating Tenants” (generally, tenants at the time the conversion to condominiums was approved by the City) may not be evicted for owner-occupancy. • Rent that may be charged for subsequent re-rental is restricted. (continued on next slide) Santa Monica Rent Control Board 47
Limitations on Evictions for Owner Occupancy : Restrictions on Selection of a Unit • Cannot evict from a unit if there is a comparable unit on the property that is already vacant. • Cannot evict from a unit if there is a comparable unit on the property that has been occupied by the current tenants for a shorter time. • Comparable means same number of bedrooms with square footage that varies by no more than 15%. Santa Monica Rent Control Board 48
Other Limitations on Eviction • Good cause eviction protections have been extended to tenants in multi-unit buildings that are not subject to the Rent Control Law. The following limitations apply to rent-controlled and non-rent-controlled properties: • If a tenant is accused of lease violations, nuisance activity, or denying an owner lawful access to a unit, written notice specifying a reasonable time to correct must first be served before eviction procedures begin. • Additional limits were placed on evictions for owner- occupancy if the tenant is terminally ill, disabled or at least 62 years old. Santa Monica Rent Control Board 49
More Limitations on Eviction • Municipal Code provides a substantive defense against no fault eviction if: – A child under the age of 18 or any educator lives in the unit; or – A child or educator is a tenant in the unit or has a custodial or family relationship with a tenant in the unit; and – A tenant has lived in the unit for twelve months or more; and – The date the tenant must move out of the unit falls during the school year. Santa Monica Rent Control Board 50
Tenancy Buy-Outs The law does not prohibit a landlord and tenant from entering into a voluntary agreement to terminate a tenancy in exchange for money; however, the procedure is controlled by City law. Among other things, before a landlord makes a buyout offer, the landlord must give a tenant a written notice of the tenant’s rights pertaining to buyout agreements. Those rights include: • the right to not enter into a buyout agreement; • the right to consult with an attorney and/or the Rent • Control Board before signing the agreement; and the right to cancel the agreement at any time up to 30 days after all parties have signed it. Additional information regarding buyouts can be found at the Rent Control Agency’s website. Santa Monica Rent Control Board 47
