Other Bill of Rights Protections

th 4 � Amendment � 1. Protects citizens from “unreasonable searches and seizures” � 2. Probable Cause- strong reasons to think the person/ property involved in a crime � 3. Search Warrant- court order that allows a search of home, business, or other property and take certain items into evidence

th 5 Amendment � 6. Included five separate protections � 7. No one can be tried for serious crime without an indictment � 8. Indictment- document issued by a grand jury formally charging a person � 9. Double Jeopardy- being put on trial for a crime one was previously found innocent � 10. Self-Incrimination- grants your right to remain silent � 11. Due Process- follow set legal procedures; laws must be fair. � 12. Eminent Domain- gov’t right to take private property (usually land) for public use

th 6 Amendment � 13. Trial by Jury Speedy and Public Jurors must be fair Held in a community where the crime took place � 14. Right to confront all witnesses against the accused Right to hear/question all witnesses Right to call witnesses in defense � 15. Right to an attorney Gov’t must pay if accused cannot afford one/

th 8 Amendment � 16. Prohibits Cruel and Unusual Punishment as well as excessive bail � 17. Bail- sum of money used as a security deposit Excessive-amt too high based on type of crime, past criminal record, likelihood of court appearance � 18. Cruel and Unusual Punishment- punishment must fit the crime

Other Amendments � 19. 2 nd Amendment- the right to bear arms shall not be infringed (limited) upon 2008 - citizens have the right to have guns for personal protection States are allowed to determine rules for firearm possession (Ex. License) � 20. 3 rd Amendment- in the absence of war, soldiers must not be quartered in private houses � 21. 7 th Amendment- right to a jury trial in civil cases as long as the dispute is larger than $20. 00 Determines roles for judges and juries in these cases Trial can be heard without a jury if both sides agree

th 9 and th 10 Amendments 9 TH AMENDMENT 10 TH AMENDMENT � States that all other rights � not spelled out in the constitution are retained by the people � Prevents the gov’t from claiming that the people only have the rights listed in the bill of rights Recognizes that the power of the federal gov’t is LIMITED! � Any powers the constitution does not specifically give to the federal gov’t go to the states � How do the 9 th and 10 th amendments protect the citizens? � How can we relate these amendments to the movies A More Perfect Union?
