一、基层 会情况 situation of grassroots union • 会领导不能代表 人:union leaders can not represent employees 表现为: 1、行政指定人员做 会主席,受制于行政方 Designated by the administrative 2、屁股决定立场,,无法代表 人说话。 Unable to speak on behalf of the workers
一、基层 会情况 situation of grass-roots union • 未实施法律意义上的选举流程: 表现为:the process are not in accordance with the law 1、缺乏法律意识,及上级监督 指导。 Lack of Law awareness, Lack of higher -level supervision. 例: 当时,可能是先组建 会,再 完善 会 形式选举,选举不规范、严肃。 At first, just plan to form a union and then improve it The election is not the norm way.
一、基层 会情况 • 会没有履行职能The union did not perform their duties : 表现为: 1、 作很难开展,行政不把 会当回事。 it is difficult to perform their duties, the administrative don't care about the trade union. 例: 行政不愿意给出平等对话 会主席兼职,会受到直接上司干预 Lack of equal dialogue mechanism Union chairs work part-time, and his/her work is directly intervened by the leaders.
一、基层 会情况 • 缺乏有梦想、思想、激情力量的 会领导union leaders are not full of passion, dreams and ideas: 表现为: 没有人愿做出头鸟而丢 作,自身利益,缺乏敢为人 先,有担当,热情的。 He worries that he may loss his job if he fight for employees’ interests. 例: 某公司,因有一批人员对相关绩效制度不满,导致全体 合同到期解雇。 For example, in a factory, some staffs are not satisfied with the performance system, and finally they are all fired after the expiration of contracts.
一、基层 会情况 • 人缺乏团结意识、法律维权意识 lack of law knowledge and solidarity consciousness : 表现为: 1、 人的软弱,退缩,多一事不如少一事心 态。 the less trouble the better 例: 国外大学校园禁止穿短裤维权意识案例。 The example of a foreign university which banned shorts and whose students struggled against that.
二、所在企业 会选举情况The situation of union’s election in my enterprise • 按照《 会章程》规定,基层 会委员会和经费审查委员会每届三或五年, 任期届满应召开会员(代表)大会进行换届改选,选举产生新一届 会委员 会 和 经 费 审 查 委 员 会 。 Trade union Committee and Fund inspection committees are elected for 3 years or 5 years. After expiration of the term, new committees should be elected. • 根据〈中华人民共和国 会法〉办法》的相关规定 • According to The Trade Union Law of People's Republic of China
二、所在企业 会选举情况The situation of union’s election in my enterprise 会主席直选制 Direct election for union chairman. 无候选人直选。不提名候选人,由会员(代表)大会通过无记名投票方 式直接选举产生 会委员会委员和 会主席、副主席。在获得法定有效票 数的被选举人中,按得票多少直接确定 会主席、副主席和 会委员会委 员。 Direct election with no candidates. General meeting vote for trade union committee members and trade union chair, deputy chair. Who get the most votes, who become the chair(or deputy chair, committer member). 有候选人直选。召开会员(代表)大会通过无记名投票方式,先采取 差额选举的办法进行预选,把预选产生的 会委员会全部作为 会主席、 副主席候选人,由会员(代表)大会采取无记名投票方式选举产生 会主 席、副主席。 Direct election with no candidates. Two rounds: first elect candidates, then elect chair and deputy chair from the candidates.
二、所在企业 会选举情况 the situation of election in my enterprise • • 选举流程(2011年 6月24日)The election process 报上级 会批示换届选举请示 Reported to the higher level trade union and get approval for the election 成立换届选举委员会,制定选举方向 set up a electoral committee 制定换届选举日程 make the agenda 制定选举办法(选举产生分配比例) Formulate measures for the election 会员代表选举 自荐、推荐候选人 召开大会 选举产生 会委员会、经审 委员会 报批,申请法人资格 履行职能 (election of representatives of union members—recommend somebody else or himself/herself for candidate – have a meeting– the election for trade union and Fund inspection committees– get approval from upper level --Perform their duties )

三、感受及未来中国 会的期待 Feelings and expectation for • Chinese unions in coming years 感受(some feelings): 1、通过正式的 会选举,意味法律的权威性,及应用,增强 会影响力, 突出 会职能,Official union elections Enhance the influence of union and also indicate the authority of the law. 2、员 的参与,代表的广泛性,选举权,选举自己信赖的 会领导,重点 是使员 知情。The key: make sure that employees have the right to know and to take part in the election. • • 3、选举流程操作的规范性,信息关键是公开的真实的,直接选举出了的 会领导 the election for chairman must be in open, direct and true ways. 会职权的全面性、真正做到为员 做事,实质是民主管理和民主监督 , 员 最终会给出评价答案。The essence of trade unions' responsibilities is democratic management and democratic supervision 例: 资集体协商, 会代表、员 代表参与协商的结果,员 代表大会均能半数以上通 过结果。有效维护了员 利益,在这个平台,员 参与名字管理,表达个人意见体 现。 For example, the result of collective bargaining can get support of more than 50% workers.
三、感受及未来中国 会的期待Feelings and expectation for Chinese unions in coming years • 思考(doing some thinking): 基层 会能发挥民主选举,如何水平展开? 政府职能部门、官方 会如何推进?(what measures should be taken by the government and the official unions to improve the democratic elections? ) 期待(expectation): 随着社会进步,人民的维权意识,文化水平 的提高、不同载体的信息交换,政府能够重 视底层的声音,引导社会进步,还需要有信 心、耐心。With the development of the society, the government pays more attention to the voice of the person that come form the bottom of society, and we should also be confident and patient.
