Objective 5. 14 How the due process protections ensure equal treatment under the law
equal protection under the law means that every citizen of the U. S. has the same rights as every other citizen
due process of law is the constitutional protection against unfair actions and unfair laws
due process of laws A person may NOT be denied life, liberty, or property without due process of laws
5 th Amendment Prohibits the national government from acting in an unfair manner
14 th Amendment Prohibits state and local governments from acting in an unfair manner
equal protection under the law The idea of equal protection under the law th 14 is guaranteed by the Amendment to the Constitution
equal protection under the law guarantees that a person accused of a crime will not be treated differently from others because of race, religion, sex, or other factors
equal protection under the law Example: judges will not let lawyers ask any questions or make comments during a trial that appear to be prejudiced or unfairly biased
Use of the due process clause to extend rights These are guarantees that have been extended by the U. S. Supreme Court
Protection from suspension of habeas corpus Def: habeas corpus A writ that is used to bring a prisoner before the court to determine the legality of his imprisonment

ex post facto laws An ex post facto law is a law that is created or changed AFTER the crime has happened

bills of attainder A bill of attainder is a law that punishes a person for a crime without a fair hearing in court
