Complementary Studies in Administrative Sciences: ‘Speyer Semester’ in Legal Education Dichotomy of legal education at the university and during the practical traineeship (‘Referendariat’) state, Training in the Referendariat is regulated differently in each federal but is based on the following scheme: 5 internships in two years - Civil law internship - Criminal law internship - Administrative internship - Solicitor internship - Elective internship Unique status of the University of Speyer as a training center based on § 5 DRi. G, the Administrative Agreement of all Länder of 1952 and the lawyer training laws and regulations of all ‘Länder’ 17
Complementary Studies in Administrative Sciences: ‘Speyer Semester’ in Legal Education Background: Training of future lawyers is one of the few training paths uniformly governed on the basis of federal law Federal legal training objective: ‘Qualification for the office of judge’ as a prerequisite for admission to the profession not only for judges, but also for public prosecutors, lawyers, notaries. . . and in many cases also for the higher service in the general internal administration (‘unitary jurist’) In Germany, administration is traditionally understood primarily as law enforcement Most members of the higher administrative service in Germany are lawyers (formerly ‘lawyer monopoly’, today ‘lawyer privilege’) 18
Complementary Studies in Administrative Sciences: ‘Speyer Semester’ in Legal Education Complementary studies in administrative sciences (‘Speyer-Semester’) is integrated into the legal preparatory service of all ‘Länder’ The Länder send out their trainees for - administrative internship - elective internship - solicitor internship (‘legal advice & legal structuring’) One semester, three months, no degree but a certificate Terms: 1 May to 31 July and 1 November to 31 January >70 % of the students are in complementary studies 19
Complementary Studies in Administrative Sciences: ‘Speyer Semester’ in Legal Education § 28 of the Legal Training Regulation Rhineland-Palatinate (1) During the training at the German University for Administrative Sciences Speyer in the mandatory administrative internship, the law trainee should deepen theoretical and practical knowledge in public law and acquire basic knowledge in other disciplines relevant for the public sector including administrative management and estimation of economic effects. (3) The German University of Administrative Sciences Speyer issues certificates of participation in courses and an overall certificate. In the overall certificate, the achievements of the law trainee shall be graded with one of the grades provided for in § 8 (2). […]. Also describes the content and degree of the ‘Speyer Semester’ for all other students (from all Länder). 20
