LEGISLATIVE PROCESS
NCAA Governance Structure • Council Governance (Division I) • Responsible for Division I legislative matters and includes representation from all 32 conferences. • Also referred to as ‘shared governance’. • Autonomy Governance (Big 12, ACC, Big Ten, Pac-12 and SEC) • Authority granted to enact specific legislation to allow permissive use of resources to enhance the well-being of student-athletes.

Legislative Process- Council Governance NCAA Activities NCAA Dates Big 12 Dates Conference Activities Conference, Division I Council subcommittees submission deadline September 1 NCAA Web-based publication of proposed legislation (POPL) On-or before October 1 Conference notifies membership of proposals for preview purposes. Division I Council review September 28 -30 meeting Fall Meetings (FAR/AD/SWA) Consider significant proposals and decide on possible amendments. Sponsor Amendments, Membership Amendments October – Mid. November Notify membership of amendment period. On-or before December 1 Review Official Notice. Request preliminary institutional positions on proposed legislation. Official Notice of proposed On-or before legislation is published December 1
Legislative Process- Council Governance NCAA Activities NCAA Dates Big 12 Dates Division I Council January- NCAA January FAR, ‘round table’ discussion Convention AD, SWA on proposals and meetings and amendments teleconferences Conference Activities Discuss preliminary institutional positions, Division I Council comments and points to consider on proposals. March Request final institutional positions on proposals to be considered in April by the Division I Council. March FAR, AD, SWA and DOC meetings and teleconferences Discuss nationally significant proposals for consideration in April.
Legislative Process- Council Governance NCAA Activities NCAA Dates Big 12 Dates Conference Activities Division I Council meeting to vote on all proposals. 60 -day rescission period (if applicable) April Prior to April Division I Council meeting Finalize institutional positions on proposals to be considered by the Division I Council. Current Council Governance Legislative Cycle is Completed May AD, SWA and coaches meetings Discuss proposals adopted by the Division I Council and approved by the Division I Board of Directors. May 1 Solicit for Conference legislative initiatives for the upcoming academic year’s legislative cycle

Hardship, Medical Absence and International Competition Waivers Process Request submitted. Conference review. Conference requests additional information/documentation. Conference determines that information/documentation is complete. Institution submits requested information/documentation OR informs the Conference office that the requested information/documentation is unavailable. Staff action taken. [Preliminary verbal/email notification, with formal electronic notification subsequently provided] Approve. Deny. Institution submits request for reconsideration based on new information standard. Uphold Staff Action
Hardship, Medical Absence and International Competition Waivers Process [Appeal Process] Institution’s FAR requests review by the FAR Council. Overturn staff decision - Approve Uphold staff decision - Deny Institution may request appeal to the NCAA Student-Athlete Reinstatement staff. NOTE: A report of action taken by the Conference office on belated medical hardship waivers will be provided to the FAR Council at each in-person meeting.
C. R. 7. 6 Waivers Process Request submitted. Conference staff reviews to ensure that all required documentation is included (i. e. transcripts, prescribed form). Does the waiver request involve an in-season student-athlete with impending competition? YES Forward to the FAR Council for action via conference call or fax ballot. NO Approved Forward to the FAR Council for action at its next scheduled in-person meeting. Denied Institution submits request for reconsideration based on new information standard. Action upheld. Action overturned.
Self-Reporting Level III and Level IV Violations • C. R. 7. 2. 1 (Level III and IV Violations) • Level III and IV violations shall be self-reported by each Member Institution in accordance with current NCAA legislation, any applicable Conference rule, directive or interpretation. • Each Level III violation shall be signed by the institution’s Faculty Athletics Representative and submitted to the NCAA via RSRO. • Each Level IV violation shall be signed by the institution’s Faculty Athletics Representative and submitted to the NCAA via RSRO with a Conference signatory required.
Self-Reporting Level III and Level IV Violations • A Breach of Conduct (Level III violation) is an infraction that is isolated or limited in nature, provides no more than a minimal recruiting, competitive or other advantage and does not include more than a minimal impermissible benefit. • Multiple or repeated Level III violations may collectively constitute a Significant Breach of Conduct (Level II violation). • An incidental infraction (Level IV violation) is a minor infraction that is technical in nature and does not constitute a Level III violation. • Level IV violations generally will not impact eligibility for intercollegiate athletics. • Multiple or repeated Level IV violations may collectively constitute a Level III violation.
Reporting Major Violations • C. R. 7. 2. 2 (Potential Major Violations) • Member Institution may conduct its own investigation and file a self-report acting in concert with the NCAA enforcement staff • Member Institution may proceed with the assistance of the Conference staff as well • The Faculty Athletics Representative shall keep the Commissioner apprised of significant developments
