COVID-19 PAUSE • As a reminder, on April 13, 2020 the Offices of Maine. Care Services and Aging and Disability Services announced a 60 day pause on HCBS validation strategies (April 13 - June 12, 2020) • These strategies include IEAs, on-site validations and desk level reviews conducted by OADS • The Department is reviewing the CDC guidance and Governor mandates in relation to and potential in lifting the HCBS pause Maine Department of Health and Human Services 4
Validation Visits, Setting Findings Report, & Transition-to-Compliance Plans As of May 12 th: • 79 settings have been validated by DRM • 72 settings findings reports have been provided to providers • 7 settings have been identified as possessing characteristics that isolate individuals and require “Heightened Scrutiny” • 18 remediation responses have been received in the portal • 836 Individual Experience Assessments have been completed Maine Department of Health and Human Services 5
Desk Level Reviews • A team of OADS staff have been identified to conduct desk level reviews and have participated in DLR training provided by Econ. Sys • First phase of DLRs will consist of mini desk level reviews for settings where IEAs have been completed • Mini DLRs will focus on the specific setting criteria that cannot be verified via IEAs, such as: • Location of the setting (adjacent to or under the same roof as a building that houses a publicly or privately operated setting providing inpatient institutional care (SNF, ICF IDD, IMD) or hospital. • Whether the setting is on the grounds of, or immediately adjacent to, a building which provides institutional care (as noted above) Maine Department of Health and Human Services 6
Desk Level Reviews (cont. ) • Whether the setting provides people receiving HCBS with the choice to receive services being provided in non-disability specific settings • Whether the setting provides supports to people receiving HCBS in non-disability specific locations such as supports for integrated employment, volunteering in the broader community, and engagement in integrated activities in the broader community • Whether people have a choice of a private room or unit, if personal resources enable them to afford the cost • Whether people sharing a bedroom have a choice of who to share with Maine Department of Health and Human Services 7
Desk Level Reviews (cont. ) • Whether the setting has a lease, residency agreement, or other form of legally enforceable written agreement in place with people receiving HCBS that live in the setting and which provides the same rights, responsibilities, and protections from eviction otherwise required under the state’s landlord-tenant law or a comparable local ordinance • Whether the setting has practices, procedures, and policies to ensure all information about people receiving HCBS is kept private and confidential • Mini DLRs may begin immediately when the HCBS 60 Day Pause has been lifted Maine Department of Health and Human Services 8
Statewide Transition Plan (STP) • Maine’s STP was submitted on April 23, 2020 • Maine received questions from the Centers for Medicare and Medicaid Services (CMS) which we have responded to • Currently awaiting further communication from CMS as to the approval status of Maine’s STP Maine Department of Health and Human Services 9
