Chapter 10: Information society and media Improvements of Legislation ØLaw on Free Access to information (Official Gazette of Montenegro 44/12) ü Adopted on 9 August 2012, Agency for Personal Data Protection decides on the appeal against a decision on a request for access to information. üCouncil of the Agency is obliged to decide on appeal in 15 days üLaw enters into force on 18 February 2013 ØDuties of the authorities üWho are the authorities? Chapter 10: Information society and media Responsibilities of the Agency (Agency for personal data protection and the free access to information - from 18 February 2013) 1)Overseeing the legality of administrative acts which decides on requests for access to information and take measures prescribed by law; 2)Administrates information system for access to information; 3)Monitors the situation in the area of access to information; 4)Performs inspection supervision over the implementation of this Law in relation to the creation and updating of access to information, proactive disclosure and submission of documents and data for management information system to access information. 5)Submits requests for criminal proceedings for violations of the provisions of this Law relating to the creation and updating of access to information, proactive disclosure and submission of documents and data for management information system to access information. Chapter 10: Information society and media HOMER PROJECT Main objective Ø to build a transitional initiative promoting the use of an ICT MED strategy towards a better access, re-use and exploitation of regional data belonging to some of the most strategic domains of the MED economy. Ø to promote a coordinated approach to stimulate accessibility and re-use of Public Sector Information owned by MED governments, in order to contribute to speed up data transparency and exchange between MED territories, by enhancing access to public information. Ø fully in line with EU policies promoting a wider re-use of PSI, considered a primary content resource for digital products and services in a transnational context. Chapter 10: Information society and media HOMER PROJECT Ø Specific objectives related to Montenegro • Dissemination and Raising of Awareness – Two main target groups: • private companies/business MED environment aiming at exploiting public digital heritage • public administrations not involved in the project and interested in re-using the PSI methodology and in being involved in the PSI MED Federation • Capitalisation – regional and public authorities involved will develop a MED PSI Federation among all the regional portals, aiming at sharing common data sets related to the Med areas – the Federation will ensure a long lasting sustainability and the possibility to exploit a huge number of datasets thanks to the federation’s benefit; – each region will develop an Implementation Plan reporting the long term strategy and the relevant funding mechanism (i. e: future ROPs under new Cohesion Policy objectives). – the partners will ensure relevant links with other running or future initiatives at regional/national and EU level on PSI related to specific subthemes or events. Chapter 10: Information society and media HOMER PROJECT Ø Improve access to public data and the participation of people in public policies (the core activity) – State of the art among the regions related to the PSI strategy and related to the development of OPEN DATA portals/ PSI Directive receipt; – Legal adjustment (i. e. : availability of national or region law enabling the reuse of data; licensing issues, etc. ) – Technological adjustment (regional or national governments involved should work on data standardization, metadata issues and other technological aspects such as multilingual aspects). – PILOT a: regional contests targeting innovative entrepreneurial idea exploiting open data; PILOT b: a regional contest targeting innovative ideas stimulating e-participation actions – Development of regional/national OPEN DATA portal in Montenegro MONTENEGRO Negotiating Team for the Accession of Montenegro to the European Union Chapter 10: INFORMATION SOCIETY AND MEDIA
