Chapter 27: Environment and climate change Law on Environment Article 21 - Environmental protection instruments Environmental Management System (EMAS) is recognized as one of the Environmental Protection Instruments. Article 29 - Environmental Management System (EMAS) In order to be incorporated into the environmental protection management and control system and to be able to inform the public on impacts of certain activities on the environment, legal persons and entrepreneurs can become members of the European Union Ecological Management System and Audit Scheme (EMAS). Chapter 27: Environment and climate change Law on Environment Article 30 - EMAS System Registry The registry of legal persons and entrepreneurs registered with the EMAS System is managed by the Agency. Methodology for enlisting the legal person and entrepreneur into the EMAS System, conditions that legal person and entrepreneur have to meet in order to be enlisted, methodology of data collection about legal persons and entrepreneurs, contents and methodology of administering the Registry from paragraph 1 of the Article, are defined by Government regulation. Chapter 27: Environment and climate change Law on Environment Article 38 - Information System contains data and information on the state of environment, loads and impacts on the environment, and in particular the data on: Organizations within the EMAS system; Article 67 - Inspector's rights and duties Inspection supervises, in particular: -Whether conditions are met for inclusion into the EMAS system, i. e. activities of legal and natural person within EMAS system in line with prescribed conditions; MONTENEGRO Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE

Chapter 27: Environment and climate change EMAS REGULATION - Current status of implementation - • Implementation of the EU EMAS Regulation has not started yet • There is no national eco-management and audit scheme established in Montenegro • There are plans that the Ministry of Sustainable Development and Tourism might be considered to be the competent authority. Main partners should be EPA, Chamber of Commerce and Accreditation Body • The legal/institutional framework will be establish before accession to the EU • The new Law on Environment planned for 2014 shall contain a provision on application of the Regulation in Montenegro before accession to the EU.
