Frank J. O’Leary Executive Director of the Oregon Rangeland Trust A little history about myself: Ø Ø Ø I have been a professional administrator for 34 years 22 years with the Walla Frontier Days 10 years with the Central WA Chapter of the PGA The last two years I have served as the Executive Director of the ORT. During most of my professional career I have been fortunate to be involved in the agricultural community raising asparagus and alfalfa for 15 years. Additionally, we raised and fed cattle for 20 years. Ø Additionally, I rodeo in the PRCA for 18 years.

The Oregon Rangeland Trust was organized by the Oregon Cattlemen’s Association. ORT was incorporated as a separate 501(c)(3) corporation in 2001. Members of the BOD of ORT must be members of the OCA or WCA and a majority must be producers. Ø The Oregon Rangeland Trust exists to serve the Ranching and Farming community in the State of Oregon. Ø The thing that sets us apart form other land trusts is that we were started by the OCA, ORT Board of Directors are members of the Oregon or Washington Cattlemen’s Association. Ø ORT is a member of the Partnership of Rangeland Trusts, a national organizations made up of Land trusts that are affiliated with or have a working agreement with their state cattlemen’s association. Ø Our mission is to keep working ranches and farms in production as privately owned working landscapes.

The mission of the Oregon Rangeland Trust is to help Oregon ranch and farm families protect and preserve the long-term viability of their ecologically significant private lands. So what does that mean and how do we accomplish it? What it means: Ø Many ranches and farms to are being sold for purposes other than working landscapes. Ø Pressure comes from investors looking for areas of development or from those who want the ground taken out of agricultural production and use it for other purposes. Ø Additional pressure is created by the line of succession issues that arise when one generation wishes to retire or there is a death in the family and taxes must be paid or retirements funded.

As ranchers and farmers make decisions about their business, there is great incentive to sell parcels of land for residential or commercial use. It is more profitable to sell many small plots of developed land than one large tract of undeveloped agricultural land. As a result, 11, 300 acres of farm and rangeland are lost to development each day in the United States, as reported in Rangeland Journal. The U. S. Forest Service scientists estimate over 8 million acres of rangeland are lost to development each decade. Carving western landscapes in to "ranchettes" undercuts the economic viability of communities and reduces wildlife habitat. "

How do we accomplish keeping privately owned ranches and farms as privately owned working landscapes? One way is with a Conservation Easement Ø In Oregon’s case we may have the worse land use laws in the states. Ø A good point is that CE provides a positive alternative to the land use restrictions imposed by zoning. Ø To restrict development and maintain open space Zoning imposes restrictions on land use with no compensation to the land owner. Ø CE preserve working landscapes as working landscapes and compensate the landowners for the lost value that could be gain by development.

So exactly what is a conservation easement (CE)? Simply put a CE is a

So exactly what is a conservation easement (CE)? Simply put a CE is a non-development agreement – for funding and tax benefits the term conservation easement has significance. By placing a conservation easement on the property a number of positive things are accomplished: Ø The property is protected from development except as provided in the easement for purposes necessary for the working landscape. Ø The property owner receives taxes incentives and/or remuneration for placing the easement on the property. In the flyer is information about HR 4 which was past in August of 2006 and significantly enhanced the tax benefits for donated or bargain sale easements for those involved in agriculture. These tax incentives are currently in limbo with the Farm Bill in Congress. Ø The property is monitored at leased once per year by ORT to ensure that the provisions of the CE as agreed to by the landlord, ORT, and the funders of the project are adhered to. This both protects the LL and ensures that the property is used as a working landscape with best practices, potentially enhancing the value of the property and the adjacent property.

Ø Second the conservation elements (building sites, timber harvest, mining, commercial development) to be included in the easement is determined. Ø Third the value of the conservation elements is determined. Ø The parcel is revalued excluding the conservation elements as determined. Ø The difference between the highest and best value and the value of the parcel without the conservation elements is the value of the conservation easement. Ø The CE appraisal must be done by an individual that is qualified CE appraiser.
