Several key points in Medical Practice • Actions for breach of contract are possible if a patient has paid for the treatment • A contract contains an implied that the doctor will exercise reasonable care skill and this is indistinguishable from the doctor’s duty of care in the tort of negligence. Tort: [Law] a wrongful act or an infringement of a right (other than under contract) leading to legal liability

• The standart of care expected of a doctors has dominated by the Bolam test, as modified by Balitho: the doctor will not be found to have acted negligently if the doctor has acted in accordance with a practice accepted as proper by a responsible body of medical opinion, provided that the opinion is capable of withstanding logical analisis.

Bolam test • The defendant has represented him or herself as having more than average skills and abilities, this test expects standards which must be in accordance with a responsible body of opinion, even if others differ in opinion. • In other words, Bolam test states that "If a doctor reaches the standard of a responsible body of medical opinion, he is not negligent"

4 -D in Medical Litigations • Duty: kewajiban tenaga medis untuk melakukan sesuatu tindakan medis atau tidak melakukan sesuatu tindakan tertentu terhadap pasien tertentu pada situasi dan kondisi tertentu. • Dereliction of Duty: penyimpangan kewajiban terhadap “Duty” • Damage: kerugian/ kerusakan, yaitu segala sesuatu yang sebagai akibat dari layanan kesehatan/ kedokteran yang diberikan oleh pemberi layanan, • Direct causal relationship: hubungan sebab akibat yang nyata. Harus terdapat hubungan sebab akibat antara penyimpangan kewajiban dengan “damage”, yang setidaknya merupakan “proximate causes” 25

Duty of Care • Duty of Care arises where one individual or group undertakes an activity which could reasonably harm another, either physically, mentally, or economically.

Dereliction of Duty • Dereliction/ breach of duty is not limited to professionals or persons under written or oral contract; all members of society have a duty to exercise reasonable care toward others and their property. A person who engages in activities that pose an unreasonable risk toward others and their property that actually results in harm, breaches their duty of reasonable care.

Damages • Special damages: - quantifiable dollar losses suffered from the date of defendant's negligent act (the tort) up to a specified time (proven at trial). Special damage examples include: lost wages, medical bills, and damage to property such as your car. • General damages: these are damages that are not quantified in monetary terms (e. g. , there's no invoice or receipt as there would be to prove special damages). A general damage example is an amount for the pain and suffering one experiences from a car accident. Lastly, where the plaintiff proves only minimal loss or damage, or the court or jury is unable to quantify the losses, the court or jury may award nominal damages, sometimes the symbolic $1 you see the jury award in movies.

Damages • Punitive damages: Punitive damages are to punish a defendant, they are NOT to compensate plaintiffs in negligence cases. Therefore, punitive damages are NOT obtainable in a negligence case. Punitive damages are awardable only in cases where a defendant has been found "guilty" of intentional, reckless or malicious wrongdoing, such as fraud, defamation or false imprisonment. The easy way to remember this concept is to think about a car accident where there is physical injury. If the defendant driver was negligent (say by running a red light) then punitive damages cannot be sought. But if the defendant driver was drunk then punitive damages could be awarded

Medical Negligence • "Negligence" is not the same as "carelessness", because someone might be exercising as much care as they are capable of, yet still fall below the level of competence expected of them. • s. Kasus ML 02/07/07 • Pasien Laki-laki, 42 thn, wiraswasta yang berhasil, distributor 3 merk terkenal, ke Klinik dr. U, dengan keluhan mual muntah, badan sering gatal, anemis, GDS 230 mg/d. L BP 160/95 mm. Hg; Lingkar pinggang 95 cm, sering sakit kepala, tadi pagi nyeri kepalanya sangat hebat. • Diberi Rx: obat anti hipertensi Gol ARB, antasida dan anti histamin, serta diberi dua suntikan 2 x (Sore). • Malam jam 8 pm, isteri menelpon dr. U, karena suaminya bertambah parah. Minta kunjungan rumah; dr. U setuju, namun setelah praktek selesai. • Jam 12 pm, dr. U, ke rumah pasien, menemukan pasen sudah tidur dan ngorok. Merasa ragu, dr. Dasar hukum penuntutan ganti rugi: • Pasal 55 UU No. 23 thn 1992 tentang kesehatan: (1) setian orang berhak atas ganti rugi akibat kesalahan atau kelalaian yang dilakukan tenaga kesehatan. • Pasal 1365 KUH Perdata: tiap perbuatan melanggar hukum yang membawa kerugian kepada seorang lain, mewajibkan orang yang karena salahnya menerbitkan kerugian itu, mengganti kerugian tersebut. • Pasal 1366 KUH Perdata: setiap orang bertanggungjawab tidak saja untuk kerugian yang disebabkan perbuatannya, tetapi juga untuk kerugian yang disebabkan kelalaian atau kurang hati-hatiannya. • Pasal 1367 KUH Perdata: seorang tidak saja bertanggungjawab untuk kerugian yang disebabkan perbuatannya sendiri, tetapi juga untuk kerugian yang disebabkan perbuatan orang-orang lain yang menjadi
