Agenda Why do we have a Bill of Rights? First 10 Amendments 1791 – The first 10 amendments are added. – Fulfills promises made during the Ratifying Conventions Civil Liberties & The Bill of Rights
Why a Bill of Rights? Federalists – Supporters of the Constitution who favored a strong national government Alexander Hamilton, James Madison, and John Jay published a series of articles known as the Federalist Papers to get people to support the Constitution
Why a Bill of Rights? Antifederalists – People who opposed the Constitution and did not support a strong federal government
Why a Bill of Rights? Some people were afraid that states might not ratify, or approve the Constitution without a Bill of Rights. Thomas Jefferson Stated that a Bill of Rights was the only way to prevent the government abusing people’s rights Afraid government would abuse rights like King George

Bill of Rights – 3 rd Amendment Prohibits the government from forcing people to house soldiers Military cannot force people to quarter soldiers Prevents things like the Quartering Act
Amendment IV - “The right of the people to be secure in their persons, house, papers, and effects, against unreasonable searches and seizures, shall not be violated. ” Search warrant – court order allowing police to search as suspect’s home or business and seize items as evidence. Big Brother is watching you!

Amendment V - “ No person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a grand jury, Grand Jury – a group of individuals (jury) who decide if there is enough evidence to start a trial.
Bill of Rights – 5 th Amendment - Person accused of a crime will not be denied life, liberty, or property without due process. 5 parts Indictment by a Grand Jury Does the evidence suggest that the person committed the crime? Protects against self-incrimination Having to testify against oneself.
Amendment V - “…nor shall be compelled in any criminal case to be a witness against himself or herself, …” Persons accused of a crime do not have to provide evidence against themselves. This is called pleading the fifth Other key terms: • Due process – following established legal procedures • Eminent domain – gives the government the right to seize land for public use

Amendment VI - “… and to have the Assistance of Counsel for his defense. ” Miranda Rights: • You have the right to remain silent. Anything you say can and will be used against you in a court of law. • You have the right to speak to an attorney, and to have an attorney present during any questioning. • If you cannot afford a lawyer, one will be provided for you at government expense.

Amendment VIII - “…nor cruel and unusual punishment inflicted. ” 8 th Amendment – Protects. against imprisonment or punishment that is excessive Excessive bail Bail, or posting a cash guarantee, permits the person to go free until their trial. Cruel and Unusual Punishment Penalty should fit the crime
Bill of Rights – 9 th Amendment – People have rights that aren’t mentioned in the Constitution Can’t possibly list every single right, but wanted to let people know they had other rights.
