C. P. C. Leave Rules or Liberalized Leave Rules, 1949 : The rules apply to: • The Railway Servant appointed on or after 1. 2. 49 • Appointed before 1 -2 -49 but opted to be governed by these rules • Temp. Rly servant with 3 years service

SPECIAL PROVISION IN RESPECT WORKSHOP STAFF [Rule 539 (2)] The workshop staff may be allowed to take leave for half a day with pay or without pay. For this purpose leave for half a day means authorized absence from duty for over half an hour.

Commuted Leave (Rule – 527) • On production of medical certificate – no limit • Approved course of study – 180 days in entire service • HLAP is commuted into full pay therefore, twice the no of days deducted from HLAP account • In continuation of maternity leave – 60 days without medical certificate • In case of resignation or vol. retirement without returning to duty, entire period is treated as HLAP and recovery is made from pay but in case of death/invalidation, no recovery is made
LEAVE NOT DUE (Rule 528) • Permanent Railway employees • Max 360 days during entire service and on medical certificate (Railway) only • When no other leave at credit • Leave salary equal to Half Pay Leave • Granted in advance and debited on future earning of HLAP, therefore limited to the earning of HLAP subsequently • Temp. Rly servant with one year service may be granted for TB, Leprosy, Cancer or mental illness under the above conditions

AUTHORITY COMPETENT TO GRANT LEAVE • First Schedule • The G. M. may delegate the power of sanctioning casual and earned leave up to 15 days to Class III and Class IV (Group “C’ & “D” ) staff to Senior Supervisory staff in the grade of RS. 5000 -8000 (R. S. ) and above, such as Section Engineers, Traffic Inspectors, Loco Foremen and Station Masters of important stations. • SOP
LEAVE ON MEDICAL CERTIFICATE (Rule 521) • Gaz. Rly servant living within or outside RHS jurisdiction are required to produce medical/fitness certificate from AMA • Non-Gaz railway living within or outside RHS jurisdiction are also required to obtain medical fitness certificate from AMA. However they may obtain medical certificate from RMP but if leave is required for more than 3 days, should report to the Railway Doctor • If Non-Gaz Railway servant is living outside the RHS jurisdiction and no AMA is available within radius of 8 km obtains medical certificate from RMP, he may be granted leave/commuted at the discretion of leave sanctioning authority.
Maximum Leave : No Railway servant shall be granted leave of any kind for a continuous period exceeding five years unless otherwise determined by the President in view of exceptional circumstances.
EXTRAORDINARY LEAVE (Rule 530) This leave is granted when: • no other leave is admissible and • Railway Servant applies in writing for the grant of EOL even when leave is available at credit • Maximum 5 years including all other kind of leave Temporary Railway Servant: • 3 months without medical certificate • 6 months with medical certificate • 18 months for treatment of T. B. Leprosy, Cancer, etc. • 24 months for prosecuting higher studies with 3 years continuous services along with a bond for three years, supported by two sureties.
Special Leave
MATERNITY LEAVE (Rule 551) • Maternity Leave 180 days • Such leave is not debited to the leave account • One year in continuation without medical certificate including commuted leave • Up to two surviving children • Miscarriage, 45 days in entire service (ammnd. 1997) • Single spell only • Married/unmarried
PATERNITY LEAVE [(Rule 551(A)] • 15 days during confinement i. e. 15 days before or six month from the child birth • Not debited from Leave Account • Lapses if not availed • Sanctioned in single spell • Shall not be refused under any circumstances
Special Disability Leave (Rule 552 – 553) • When injury intentionally inflicted or caused in consequence of duty or official position • Injury should manifest within 3 months • 24 months for one disability as certified by AMA • Can be combined with other leave • 120 days – full pay, remaining – half pay • HLAP can be adjusted beyond 120 days for full pay • Admissible to both, Gaz & Non-Gaz
If the employee is governed by the Workmen’s Compensation Act, then the amount of leave salary is adjusted against the amount of compensation payable but in case of death or permanent disability, leave salary is restored
HOSPITAL LEAVE • Only to Non-gazetted servants • For the injuries due to risk involved in performance of duty • 120 days on leave salary equal to leave on average pay, after that half pay • Case can be considered for full pay beyond 120 days subject to such cases being reviewed by the Medical Superintendents and concurred in by Senior Divisional Accounts Officer/Associate Accounts Officer. • Max 28 months but GM has full powers with the concurrence of FA&CAO & review by CMO beyond this limit • Can be combined with other kind of leave
A Railway servant whose limb has to be amputated as a result of an injury on duty, the period from the date of healing of the wound to the date of fixing the artificial limb plus journey time till he is fit for duty should be treated as Hospital leave. This rule will also apply when such staff has to remain absent from duty for the replacement of artificial limb or for obtaining a spare limb.
STUDY LEAVE [ Rule 556 & Appendix-V] Conditions of Leave a) Direct and close connection with the sphere of duties; b) Likely to improve abilities of a Railway servant; c) It is advantageous to Government from the point of view of public interest d) it is liberally granted particularly to doctors, scientific & technical staff. e) Not for academic or literary purpose
This leave can be granted to a Railway Servant : 1. Who has satisfactorily completed period of probation and has rendered not less than 5 years regular continuous service including the period of probation. 2. Who is not due for superannuation within 3 years. 3. Who executes the bonds for a period of 3 years to serve the government after return from study leave
Maximum amount of study leave: 1. Ordinarily 12 months at a time and 2. During his entire service, 24 months in all. * Study leave shall not be debited against the leave Account of the Railway servant. * Study leave may be combined with other kind of leave but in no case shall the grant of this leave in combination with leave other than extra ordinary leave involve a total absence of more than 28 months generally and 36 months for the courses leading to Ph. D degree and P. G. Degree in medicine including the period of vacation
• Counts for Promotion, Seniority, Increment & Pension • Study Leave cannot be granted to those with less than 5 years service and to those who are due to retire within 3 years of the return from study leave • Leave abroad should not be granted to Junior Scale/Senior Scale officers including IRMS • Only Pay & DA admissible during study leave
Child Care Leave Introduced after 6 th CPC To the working woman up to two surviving children of the age up to 18 yrs (disable child – 22 years) 730 days in entire service (without proportion to the no. of children) For the purpose of Study and Sickness of child Treated at par with LAP

D. • Vasectomy operation by male Railway Servants - six working days • 7 days to male Railway servant whose wife undergoes a puerperal tubectomy for the first time or second time due to failure of the last operation • Teachers attending Science Seminar – Day(s) of seminar • Stenographers appearing in exam – Exam day + journey • Defense Asst. in D&A case for inspection of docs – 3 days • To attend Hindi Examination • To attend cooperative society meeting – 15 to 30 days in a year • To attend Trade Union Meeting – Meeting day + one day advance for consultation etc.

Probationers of Organized Railway Services appearing in Subsequent Recruitment Examination(s) vz. Civil Services Examination etc. (Rly. Bd’s letter NO. E(Trg)98(19)/2 dtd. 09. 06) In supersession to the instructions issued vide this office letter of even number Dated 28. 8. 2000, it has now been decided that the probationers of the eight Organized Railway Services selected through Civil Services Examination and Engineering Services Examination, will not be granted any kind of long leave for Preparation for any subsequent recruitment examination(s) before completing the Probationary training and passing the posting examinations. Accordingly, probationers who join railway service and wish to appear in subsequent Recruitment examination (s) should be granted only short leave covering the Period up to the exam only and not for preparation for the exam. For implementing these instructions, Centralized Training Institutes may ensure that every probationer on reporting to the concerned Centralized Training Institute is informed of the above instructions and also that noncompliance of these instructions would be viewed seriously.

523. Leave on average pay. - A Railway servant permanent or temporary other than one who is serving in a railway school shall be entitled to 30 days leave on average pay in a calendar year. The leave account of every railway servant shall be credited with leave on average pay in advance in two instalments of 15 days each on the first day of January and July every calendar year. The leave at the credit of a railway servant at the close of the previous half year shall be carried forward to the next half year subject to the leave so carried forward plus the credit for the half year do not exceed the maximum limit of {300}** days. ** Substituted vide Railway Board's letter No. E(P&A) I-97/CPC/LE-5 dated 04. 05. 98 (RBE 88/1998) - ACS No. 64. A period spent in foreign service shall count as duty for purpose of this rule, if contribution towards leave salary is paid on account of such period.
In case of Railway employees, having at their credit Leave on Average Pay of 285 days or less as on 1 st January/1 st July of a year, LAP of 15 days or proportionately less in respect of retiring persons or those leaving service during the next half year may continue to be credited to their leave account in advance as at present. In cases where the Leave on Average Pay at credit as on 1 st January/1 st July is 300 days or less but more than 285 days, credit of LAP for 15 days may be kept separately and first adjusted against any LAP that the Railway servant may take during the ensuing half year and the balance, if any, credited to the LAP account at the close of the half year subject to the ceiling of 300 days. If the LAP taken during the half year is more than 15 days the amount in excess of 15 days will, however, have to be debited to the leave account. ** Inseted vide Railway Board's letter No. E(P&A)I-2000/CPC/LE-3 dated 1. 8. 2000 (RBE 143/2000) - ACS No 78 Subject to the provisions of rules 503, 541 as well as this rule, the maximum leave on average pay that may be granted at a time to a railway servant shall be 180 days.
