Supreme Court Many historians, and Supreme Court Justices, argue that the Supreme Court really established its authority during the Marshall Court. In Justice Stevens’ book “Five Chiefs: A Supreme Court Memoir, ” he mentions that there are many justices that made their mark on the history of the Court, in their decisions, their writing, their creation of important precedent. Marshall was one such Chief Justice.
Many say that the Supreme Court did not truly establish its power until the Marshall Court and the decision of Marbury vs. Madison. Based on your HW, is this statement accurate? Why or why not?
