Minimum Wage Overview
Minimum Wage Schedule Beginning January 1, 2022 and thereafter the County CEO: Will determine the adjusted rates based on Consumer Price Index (CPI), which will take effect July 1 of that year and publish a bulletin announcing the adjusted rates.
Which Employees Does This Apply To? Perform at least two hours of work in a week within unincorporated areas of Los Angeles County. Includes: • full-time or part-time • on probation/training • non-profit organizations
Determining Unincorporated Areas Step-by-Step guide to determine what minimum wage applies to employees On a web browser open up the link below and have the address ready where the employee performs work. Unincorporated Areas Lookup Input the Street Number and the Street Name. Do not input “St. Ave. Blvd. W. N. etc. ” Then click Submit.

Unincorporated Areas Lookup (cont. ) Look for the 6 th bracket. If the work address is within: • Unincorporated area, • City of Los Angeles, • City of Santa Monica, • City of Pasadena or • City of Malibu then the minimum wage ordinance for that particular unincorporated area or city applies. Note: If address doesn’t fall within any of the areas listed on the left, the State of California minimum wage applies.
Employees Who Work at Multiple Sites • Employees who perform at least two or more hours in a particular week in unincorporated areas of the County are entitled to the County’s minimum wage. • Physical address of the employer is irrelevant. Wage is determined by where the work is being performed. • If employee does not perform work at the employer’s physical address, but performs work in unincorporated Los Angeles County, then the employer must provide those employees with copies of the required workplace postings.
Travel Time Travel time is not covered by the County’s ordinances if it: 1. Does not include employment-related or commercial stops in unincorporated areas; or 2. Includes stops in the unincorporated areas, but those stops are for the limited purpose of refueling or for the employee’s meals or personal errands.
Required Posting • If you don’t have a physical location within the unincorporated areas of the County, you must provide the notice each year to the employees who perform work in the unincorporated areas of L. A. County. • Must feature this in English, Spanish, and any other language you use to communicate to workers. • Available for free in multiple languages on our website • Printed at least legal size, 8 ½ x 14
Recordkeeping and Access Requirements Every employer must keep accurate and complete records for each employee for a period of four years. For purposes of monitoring compliance the employer must: • Allow the DCBA access to payroll records • Allow the DCBA to interview persons, including employees during normal business hours and • Cooperate with the DCBA investigators
What If an Employee Accuses Me of Not Paying the Correct Minimum Wage? The County’s Minimum Wage Ordinance and Minimum Wage Enforcement Ordinance are designed to ensure that all minimum wage complaints undergo a thorough investigation process. • Our investigation process will determine if a complaint is substantiated or unsubstantiated. • Each complaint is individually investigated and reviewed on case-by-case basis.
What the DCBA Investigates Los Angeles County’s Minimum Wage Enforcement Ordinance gives the DCBA the authority to enforce the provisions of the ordinance. This includes: • Unpaid Minimum Wages • Retaliation • Failure to Post • Failure to allow access to payroll records
Correction Order During an investigation, if a DCBA Wage Enforcement Investigator determines a violation of the wage ordinance has occurred, a correction order may be served to the Employer. The Correction Order will: • Identify the violations to be corrected, and • Give reasonable amount of time to correct the violation.
Wage Enforcement Order If these violations are not corrected in a timely manner then the DCBA will issue a Wage Enforcement Order and assess administrative fines. Wage orders are issued when there are substantiated violations of the County Minimum Wage Ordinance. The employer is required to post the Wage Enforcement Order in a conspicuous place within 24 hours of receipt.
You Can Contest a Wage Enforcement Order The employer, employee, or a third party may contest the WEO: 1. File a Request for Reconsideration (8. 101. 130 (A) lists requirements) with DCBA within 20 days from the day of service or posting of the wage enforcement order. 2. DCBA will issue a Reconsideration Determination within 20 days of receipt of the written reconsideration.
