Local Bridge Replacement Program (LBRP)
Program Overview • Provides funding assistance to local agencies for the reconstruction, rehabilitation or removal of bridges or structures on their local road system. • State Funds are appropriated based on Minnesota Statutes 174. 50 • The program was created in 1976 under Minnesota Statutes 174. 50. • Has changed very little sinception • State Aid administers the program and establishes the criteria for a bridge to be considered eligible for federal, bridge bond, MVLST, or town bridge funding. • Mn. DOT owned bridges are not eligible for LBRP funding. 2
Master Bridge Replacement Priority List • State Aid Program Administrator maintains a Master Bridge Replacement Priority List • Includes eligible local bridge projects ID’d by local bridge owners as priority over 5 years • Requires city council or county board resolution updated annually • Resolution includes all township, local (city and county), and state aid bridge projects • Estimates cost and desired year for replacement • Used for budget requests and legislative hearings to demonstrate support for local bridge bond funding • Bridges must be on Master List to be eligible for LBRP funds 3
Types of Funding and Subprograms • Four subprograms under the Local Bridge Program: 1. Federal Aid Bridge Replacement Program 2. State Transportation Fund (Bridge Bonds) 3. Motor Vehicle Lease Sales Tax (MVLST) 4. Town Bridge Program (includes Special Town Bridge) • Other funds may include State Aid and local • Chapter 4 of the State Aid Manual provides information for each type or source of bridge funds, the unique criteria in how and when the funds become available, and how they may be spent. 4
1. Federal Bridge Funds • On-system bridge application and award through Area Transportation Partnership (ATP) • Major bridges and bridges on regionally important routes often rank highly for federal funds. • Local agencies should apply for federal funds on these types of bridges. This will leave the state funds available for those projects that will not be selected by the ATPs. • Off-system bridge applications and award through CO State Aid • Selected projects must be included in the Statewide Transportation Improvement Plan (STIP) 5

Federal Bridge Funds • Eligibility criteria include: • In-place structure ≥ 20 feet and at least one of the following: • Local Planning Index (LPI) ≤ 60 LPI is a risk based analysis system for bridges or • National Bridge Inventory (NBI) rating ≤ 3 for Deck Geometry, or Approach Roadway or Waterway Adequacy • Federal funding agreement is required • Federal funds are reimbursed as work is completed by submittal of state aid pay requests through DSAE 6

State Transportation Funds (bridge bonds) • Funding Overview • State Transportation Bond Funds amounts are appropriated by the legislature through the passage of session law/bonding bill. • Session laws dictate the amount of funding provided and may include specific language regarding how funds are distributed. • Bridge bond funds are not considered State Aid funds and must be applied for on a project by project basis. • Minnesota Rules Chapter 8810 and specific session laws govern what is an eligible use of the State Transportation Funds (bridge bonds). 7

State Transportation Funds (bridge bonds), cont. • Eligibility criteria include: • Must be on Master Bridge Replacement Priority List • Located on local road and owned by a city, county or township • In-place structure ≥ 10 feet and at least one of the following: • Local Planning Index (LPI) ≤ 60 LPI is a risk based analysis system for bridges or • National Bridge Inventory (NBI) rating ≤ 3 for Deck Geometry, or Approach Roadway or Waterway Adequacy 8

State Transportation Funds (bridge bonds), cont. • Additional eligibility considerations: • Bridge construction costs only • CSAH/MSAS - eligible costs are funded 50% state aid/local and 50% bridge bonds. • Local bridges off the state aid system - eligible costs are funded 100% bridge bonds. • Cities less than 5, 000 population are eligible for all 100% of the costs in excess of $10, 000 for both engineering and approach costs. • Funds also eligible for: • Build a road-in-lieu of a bridge - limited to the structure replacement cost • Cost to abandon or remove a structure 9

Project Selection Process • Legislature appropriates funds in the program by session law • Funds projects from Master Bridge Replacement Priority List • Federal bridge projects in STIP are priority to provide match requirements • Funds are awarded on first-come/first-served basis when plans are approved by State Aid • Local agency submits application for bridge funds • After DSAE approves plans, State Aid Program Administrator reviews and verifies eligible items, and provides funding approval letter based on engineer’s estimate • DSAE provides notice to advance the status of the project to advertise and award 10
2. State Transportation Funds (bridge bonds), cont. After Funds are Approved • Local agency refines plans and specifications as necessary, resubmits to DSAE • Local agency awards project and submits low bid documentation to DSAE and State Aid Finance for final funding determination. • Bridge bond projects require one original copy of grant agreement • Agreement templates and guidance are on the State Aid LBRP webpage. • Funds are reimbursed as work is completed by submittal of state aid pay requests through DSAE. 11
3. Motor Vehicle Lease Sales Tax (MVLST) Funds • Funding Overview • Minnesota Statute 297 A. 815 allocates 13% to 174. 50 • Same eligibility criteria as bridge bonds • Funds projects from Master Bridge Replacement Priority List, similar to bridge bonds • Federal bridge projects in STIP are priority to provide match requirements • Funds are awarded on first-come/first-served basis when plans are approved by State Aid • Local agency submits application for bridge funds 12

Motor Vehicle Lease Sales Tax (MVLST) Funds, cont. • MVLST-funded projects require one original copy of agreement • Less restrictive than bond funded projects • Agreement templates and guidance are on the State Aid LBRP webpage. • Funds are reimbursed as work is completed by submittal of state aid pay requests through DSAE. 13
4. Town bridge funds • Funding Overview • 5% take-off from Highway User Tax Distribution Fund • 16% Town bridge (70/30 to town bridge and special town bridge). • Distributed to counties based on # of deficient township bridges • Special town bridge can be used by any county that depletes it regular town bridge funds • Funds projects from Master Bridge Replacement Priority List, similar to bridge bonds • Township/county coordination: • ID priorities on county board resolution for inclusion on the Master Bridge Replacement Priority List • Prioritize replacements based on LPI, local priority, and availability of Town Bridge Funds or other state funds. • Design and administration 14

Town bridge funds, cont. • Eligibility criteria include: • Must be on Master Bridge Replacement Priority List • Located on township road and owned by township • In-place structure ≥ 10 feet and at least one of the following: • Local Planning Index (LPI) ≤ 60 LPI is a risk based analysis system for bridges or • National Bridge Inventory (NBI) rating ≤ 3 for Deck Geometry, or Approach Roadway or Waterway Adequacy • Funds also eligible for “road in lieu” or to abandon/remove (up to structure replacement cost) 15

Town bridge funds, cont. • Eligible township bridge costs include: • 100% of bridge structure or culvert costs • 100% of approach grading and bridge removal costs in excess of $10, 000 • 100% of engineering costs in excess of $10, 000 • No agreement required • Township bridge funds are paid 95% at application and 5% upon completion. 16
