Copyright Licensing Agency • Fair dealing: UK Copyright Service • covers printed books, journals and magazines owned by the institution • certain works excluded • one chapter/article or 5% rule • pricing based on FTE student numbers incl. Distance Learners and non-credit bearing courses.
Music Publishers Assoc. • The CLA licence does NOT cover printed music • The Code of Fair Practice expressly prohibits the copying of “entire” works i. e. an aria (as opposed to an opera) • Students should not be making copies of songs for audition/performance purposes • Code of Fair Practice
Newspaper Licensing Agency • Separate NLA licence needed for newspapers • Photocopying, scanning, e-mailing, viewing articles on an external website • What newspapers do we copy from? or want to copy from?
What is not covered The CLA licence does not cover: – Maps and charts not even when included within published works – Unpublished material theses, dissertations, assignments, ephemera such as in-house brochures, pamphlets, supplier catalogues, company reports etc.
Digitisation and scanning Comprehensive CLA licence allows “us” to make digital copies of chapters and articles BUT within strict conditions: – Only Designated persons can do the scanning – Specific course / set duration / specified number of users – Details supplied to the CLA on an annual basis – HEI expected to have weeding procedures in place – Can be audited, and they can be strict in their audit!
Educational Recording Agency • Allows recordings from terrestrial TV channels but not any on-demand service e. g. i. Player and not Open University programmes • Copies can only be used for “educational” purposes. – What counts as “educational”? NOT a public screening for a college film club! requires additional licences: PVSL (Hollywood); MPLC (Independents) • Recordings can be onto video/DVD, or can be stored digitally • Making digital recordings available online requires the ERA Plus licence at an extra cost per FTE: ERA Plus
Phonographic Performance Licence Copyright in the public performance of sound recordings: – Staging a concert or play where live music is performed – Recording a school concert or play containing music – Holding a disco or fair or Symposium where music is played – Having a radio or TV or CD player on in admin offices – PPL
